Fair Play at FIFA?

The following post comes about as a result of the research and work put in by Auldheid.

He has drafted the submission to FIFA detailed below after closely looking at their rules, and taking on board the points contained in the Glasnost “Golden Rule” blog. TSFM has attached the blog’s name to the report since the overwhelming – but not unanimous – view of our readership is that the SFA and the SPL have again gotten themselves into an almighty and embarrassingly amateur fankle over this issue.

We believe that tens of thousands of football fans will be lost to the game if the outcome of the LNS enquiry is not perceived to be commensurate with the scope and extent of the rule breaking that LNS found had taken place. In view of this, we believe that we have to do what we can to explore all possibilities for justice for those who love the game so much and yet are utterly disillusioned by recent events.

LNS is not being questioned here. He has found that RFC were guilty as charged by the SPL.

What is being questioned is the SFA’s crucial – and seemingly conflicted  – role in the LNS enquiry, as is the effectiveness of LNS’s recommended sanction as either a deterrent or an upholder of sporting integrity.

It came to our notice last week that FIFA have created a web site at

that tells us that FIFA have implemented a regulatory framework which is intended to ensure that all statutory rules, rules of conduct and internal guidelines of FIFA are respected and complied with.

In support of that regulatory framework FIFA have set up the above site as a reporting mechanism by means of which inappropriate behaviour and infringements of the pertinent regulations may be reported.

FIFA say that their jurisdiction encompasses misconduct that (1) relates to match manipulation; (2) occurs in or affects more than one confederation, so that it cannot adequately be addressed by a single confederation; or (3) would ordinarily be addressed by a confederation or association, but, under the particular facts at issue, has not been or is unlikely to be dealt with appropriately at that level.

Discussions arising from the previous blog on TSFM, “Gilt Edged Justice”, which was published after Lord Nimmo Smith (LNS) ruled on the registration of Rangers players who had contractual side letters that were not disclosed to the SFA as part of their registration, suggest that there may be possible unfortunate consequences for football arising from the evidence presented by the SFA to the LNS enquiry that informed its findings on registration and consequent eligibility. There is also a question of the propriety of the SFA providing evidence on an issue which could have had a negative impact on them had it been found that they had failed to carrying out their registration duties with due rigour over a period of ten years when the existence of EBTs was known to officials within the SFA.

On the basis that the LNS findings require that registration rules be clarified by FIFA and rewritten globally if necessary to remove any ambiguity and under clause 3 above, this appears to be an issue that the FIFA should examine and that the SFA cannot address.

The following report has therefore been submitted by TSFM on behalf of its readers to FIFA drawing on the content and debate following the “Gilt Edged Justice” blog in respect of the possible footballing consequences of the LNS enquiry.

The hope is that by speaking for so many supporters, FIFA will give the TSFM submission some weight, but individuals are free of course to make their own points in their own way.  We await acknowledgement of the submission.

The report Submitted to FIFA is as follows;

It is our belief that FIFA general rules of conduct were breached by the SFA and their employees in both creating and then advising The Lord Nimmo Smith (LNS) enquiry into the non disclosure of full payment information to the Scottish Football Association (SFA) by Rangers F.C during a period of player registration over 10 years from 2000.

We believe that although the issue has been addressed by the SFA the particular facts at issue suggest that it has not been dealt with appropriately and we therefore ask FIFA to investigate. The facts at issue are that the process and advice given failed to uphold sporting integrity, and that a conflict of interest was at play.

We believe the advice provided and the enquiry set up, where SFA both advised and is the appellant body, breaches not only the integrity the registration rules were intended to uphold, but also totally undermines the integrity of the SFA in breach of General Conduct rules 1, 2 and 4. (See below.)

1.  Firstly we believe that the advice supplied to LNS that an incorrectly registered player was eligible to play as long as the registration was accepted by the SFA however unwittingly, undermines the intent of the SPL/SFA rules on player registration and so undermines the integrity of football in three ways.

• It incentivises clubs to apply for a player to be registered even if they know that the conditions of registration are not satisfied, in the hope that the application will somehow ‘slip through the net’ and be granted anyway (in which case it will be valid until revoked).

• A club which discovers that it has made an error in its application is incentivized to say nothing and to ‘let sleeping dogs lie’ – because it would be in a better position by not confessing its mistake.

• And most importantly, it incentivises fraud.  By deliberately concealing relevant information, a club can ensure that a player who does not satisfy the registration conditions is treated as being eligible – and therefore allowed to play – for as long as a period as possible (potentially his entire spell with the club). Then, if the club is no longer around when the deception is finally discovered, imposing meaningful sanctions may be impossible.

2.   Secondly we believe the process followed was inappropriate due to a Conflict of Interest. Had the LNS enquiry not ruled on the basis of advice supplied by The SFA, they and those persons advising the LNS enquiry, could have been subjected to censure and the SFA to potential compensation claims had LNS found that the players were indeed ineligible to play and results then been annulled as was SFA practice when an ineligible player played.

3.  Finally we contend that a law should not be applied according to its literal meaning if to do so would lead to an absurdity or a manifest injustice or in this case loss of football integrity.

4. We therefore ask FIFA to investigate both the process used and advice given to Lord Nimmo Smith to satisfy themselves that FIFA’s intentions with regard to upholding the integrity of football under FIFA rules have not been seriously damaged by the LNS findings and also to reassure Scottish football supporters that the integrity of our game has not been sacrificed by the very authority in whose care it has been placed to promote the short term cause of commercialism to the games long term detriment.

1. Persons bound by this Code are expected to be aware of the importance of their duties and concomitant obligations and responsibilities.

2. Persons bound by this Code are obliged to respect all applicable laws and regulations as well as FIFA’s regulatory framework to the extent applicable to them.

4. Persons bound by this Code may not abuse their position in any way, especially to take advantage of their position for private aims or gains.

    A lot of the current issues Rangers have is the “non salary” expenses which the previous club had and were to a large extent likely to be carried forward to the new one. From memory that was about £14m, an amount difficult to cut whilst still operating Ibrox Stadium, Murray Park etc.

    Yes, agree entirely and of course by renting these things they would find the black hole draining cash quicker than ever. You’d have to doubt whether they’d really have any hope of returning to the challenge at the top in that circumstance. Ever.


  4. Great post today Humble … IMO Campell Ogilvie is still clinging to his job, for one very selfish reason; the position of president of the SFA is his final step to attain that three letter title, so coveted by all ‘establishment’ men – A Knighthood!

    For the best part of 35 years he has given his working life to football administration and some would even say effectively. So he’s got the CV, he’s also got the brogues and blazer and he undoubtedly has the ‘background’ to get the fulsome support of Scotland’s political and social elite.

    What he hadn’t take into account, was the mother of all sh#tstorms that was to hit his one true love. He’s now keeping his head well and truly down, while doing his damnedest to mitigate and diminish the past actions of the team from Ibrox. And by successfully doing so, his own well placed tilt at a peerage stays on track.

    In my opinion, there is only one viable option of they want to keep the whole thing going.

    Really start again this time, really live within their means, really tell the truth to the fans.

    I think that in doing that they could keep a very reasonable amount on board, and build the club from there. Something like 25,000 season ticket holders and regular attenders would still dwarf almost every other club. That could be built upon.

    It could be done, it would take time. However it would have to be based on reality. Simply re-using a totally untenable business model is not the answer.

    Some fans will not accept the truth, but I am sure that a football club called Rangers will survive without them. It may not be what the fans who remain are used to in terms of success, but at least it will be their team. Not all rangers fans think that they are the People.

    Spot on. It is almost certain that the properties are now owned by RIFC, whereas TRFC just owns a loss making football club. TRFC will currently be losing about £2m per month in cash terms. If they are sold or given to trueblue knights, then rent will have to be paid, and there will be a large debt due to RIFC, who after all have been paying all the bills for the last 6 months.

    This is surely now the end game. The PLC (RIFC) will come out of it holding valuable property, some cash, and a large debt due from TRFC. TRFC will come out owing millions to RIFC, a load of people on big contracts who will be difficult to get rid of, rent to pay if they want to play at Ibrox, no cash, over £2m a month outgoings, and insolvent unless a real billionaire arrives.

    And let’s not forget the various investigations hanging over all concerned. Surely trading in RIFC shares must be suspended before Monday? If not, we are truly living in a madhouse.

    They can’t turf the scum out.
    Even if everything was made as if Whyte or Green were never there they would still be an initial £18M in debt. They would owe the already agreed £4M to HMRC for the unpaid tax in the early 2000’s. That’s £22M.
    Now while the liquidators can undo the sale HMRC are still due their £16M in unpaid Tax an NI for the eyear CW was in charge which takes the total to £38M.
    Ooops forgot about all the other creditors so lets be generous and call it another £5M.
    Total £43M in debt.
    Nobody wanted to pay it the first time so no one is going to pay it now considering they are still running a business model that loses at least £10M a year.

    For the real RFC fans this doesn’t end well. At best they may have a team playing somewhere after more jiggery pokery by the powers at Hampden but I think the ground could very well be locked as there will be a court case to determine who owns it. Now if this process moves as slowly as every other aspect of this case then the ground could be closed for two years and what state it will be in by then is anybody’s guess.
    As I’ve said before if the they are liquidated then they will simply be relgated back to the bottom tier and it will start all over again. After all they will be a new club so if they couldn’t retain the place in the SPL last time round why would they be promoted this time.

I’ve lurked here and on RTC for over a year and have seen many posts stating that This was definitely going to happen and That was definitely going to happen and lo and behold…………even yesterday was supposed to be a BIG news day and again nothing happened.     If as you say the properties are now owned by the holding company then the holding company will owe The Rangers an amount for the properties which as I recall were valued upwards at the half year. So the debts work both ways.

    Maybe the cash going into The Rangers will equal the property value soon and then The Rangers can be sold debt free and able to pay rent to RIFC? Step forward Sir Cardigan and Prince Alistair to front the purchase.

    The SFL and SPL and exactly the same.

    I believe it is a lack of backbone that stops them applying the rules to TRFC.

    Greed and comfort should be their motto.

    If Scottish football is to move on, we need people running it to have a backbone instead of a route to an easy pension.

    I fear you are onto many TD’s for that post.

    My way of thinking is that there are many Rangers fans who are not bigots and are merely supporters of the club (hell some of them are friends of mine). There will always be a Rangers for the reasons we are all aware of and to my mind we need to reach a Norn Ireland type compromise. We don’t like what they stand for but they will be around anyway so lets get talking and help the fans win back their club from the spivs.

    I don´t believe the club ever had a political party and in recent years it has neglected any politics, nous assoociated with politics or politcal link with supporters for instead corporate mismanagement and attempted financial gain.
    Reflecting a lot of what is bad in todays society and ironically divisive in the week Thatcher died.

    As for the individual supporter, you can´t tell an individual what to think, believe in or which political party to vote for.

    If you would like to instruct people on how to think I suggest you go into PR and send a job application to one Jack Irvine (MH).

    Exactly what you say – people hate the team who play out of Ibrox. That I can understand.

    But to hate fans of the team – and I can also understand why some fans would be hated (but, let’s be honest, not all fans of all teams are likeable) – just because they happen to support that team, I don’t understand.

    You are simply no better than the worst of that teams support.

    I go to watch football, because I love watching football. Other fans do the same. I have no beef with them. They support who they support.

    Too often there are posts on TSFM where ALL Rangers fans are tarred with the same brush. And it just passes as if that is the way it is. That’s fine, if that is what Big Pink, and the majority of posters want this site to be, fine. It’s not my site, I only post occasionally. Bash on with with you want.

    There is no point of me posting every other day and offering nothing more than “well, I don’t think that’s fair..”

  30. there is a political movement at ibrox that wants to sing and celebrate not football but past battles.

    Scotland as a country needs to move on, especially the west which is a generation behind the rest of the country in they way some of them think and act. I have no time for the Neanderthals at Ibrox and parkhead fighting battles long since ended. I hope better education in our schools will teach their children to think for themselves.

    For what its worth I think that lots of innocent Rangers fans are suffering acutely now, through no fault of their own. Lots of other fans of other clubs suffered for decades through no fault of their own either in the SDM era.
    I put it to you both that the titles of the last decade were won with as much probity, decency and honesty as the RFC takeovers of the past 2 years were conducted. Sure, there was honest endeavour from all sides in the sporting competitions, but it was played on the backdrop of a field that was surreptitiously, yet deliberatley tilted in favour of 1 team.
    Now the RFC fans didn’t tilt that field, but tilted it was nevertheless.
    Argue the technicalities until you are blue in the face. EBT appeal allowed, LNS says no sporting advantage ya da ya etc.
    Fact is, if the referee awards a throw in the wrong way, whether by error or mendaciousness, that doesn’t alter who the ball hit on the way out when you come to look at the video evidence.

    I believe decent RFC fans wouldn’t – in their heart of hearts – want to lay claim to tainted titles even if they were not themselves culpable in the corruption that favoured them.

    And decent fans of other clubs should recognise that we only tend to ask questions when things AREN’T going our way, so those decent RFC fans are entitles to some slack for not asking those questions themselves sooner.

    A better Rangers for teh decent fans would be the best result that could emerge, as a result of the pain on all sides.(No sectarian baggage, dignity, integrity… and a wee drop of humility even!). There is something for fans of all clubs to aspire to.

    But be absolutely clear on this: No rangers would be a better outcome than the same Rangers as we had before!

    So as I see it, theglen2012, smartbhoy… you are both right.
    But neither of you can lay cliam to any moral high ground as a result.

  34. Can anyone explain to me why a partner with “The Rangers” who until 2 weeks ago continued to espouse the propaganda of the said “The Rangers” has suddenly turned on their CEO. Everything Mr Verde said until this point was The Gospel. What has changed apart from a few tapes released by MBB and some inappropriate comments from Verde. Why did STV release a tape 6 months after the event when Verde said “no surrender”. According to PMcG the MBB tapes were around in October. Why now? What has changed? Has Verde served his purpose?
    IMHO the MBB was brought in to take “The Rangers” into administration or liquidation. Clear all the debts. Not all worked out as planned as the rest of the scottish football fans said “no way” to “The Rangers” parachute into the SPL. Green was also useful and rallied the troops. Has he now served his purpose? It is rather surprising that STV have suddenly found some journalists who are interested in “the truth.” The WS, Ally and SDM are never criticised and were duped. My Ass. The media will now back these “Real Gers Men” to come to the rescue and sort out this sorry mess. No punishment will be imposed by that inept organisation the SFA.

  36. We all know the real root of the problem. It can be summed up in one quote, one soundbite.

    “For every five pounds Celtic spend, we will spend ten,”

    That is why we are where we are today. Not because of Craig Whyte or Charles Green or spivs or any other parasite. They are a consequence of that attitude, nothing more. They saw an opportunity and took it. That is what they do.

    He said that because the bank, or more importantly Gavin Masterton was willing to give him anything he wanted. As much money as he wanted. So he genuinely could spend those “tenners”.

    The problem was, the business wasn’t bringing the money in to finance the debt.

    If there are two men responsible for the current financial problems in Scottish football it isn’t Craig Whyte and Charles Green, as I said they are just parasites trying to profit from a situation. It is David Murray and Gavin Masterton.

    So mote it be.

    Murray was a disaster for Scottish football aided and abetted by a corrupt bank which sought to use its financial muscle to dictate the entire game and rendered it sterile and, for all supporters beyond the Celtic /Rangers axis, very tiresome.

    Somehow the game’s clubs developed a Stockholm syndrome of dependency upon those confining them and allowed and fostered an administration that was inimicable to their real sporting interest but apparently looked after their financial ones, yet simultaneously interest in and support for the game outwith the big two diminished to such an extent and the finances were drawn up such that all additional monies found their way to Ibrox – where it was sunk into a bottomless pit – and Celtic Park where it sustained the only meaningful and sustainable opposition to the will of the bankers.

    The rejoicing at Rangers’ demise last season was, thus, far more than an embittered schadenfreude but rather a positive sense of change coming. The antics of the authorities in re-inventing and replacing Rangers with ersatz Rangers at the behest of the clubs soured that sense of revolution and hope and now we see the complete disintegration of the Tribute act probably bringing down the entire edifice ( or it certainly should) of the game with it.

    Such has been the complicity of the clubs and the MSM and wider establishment that were the Tribute act to fail and not be resurrected as all sense would suggest, given the reality of the conspiratorial conmen and their hold on the assets and licence of Rangers and their greed and desire for cash above any other consideration, then much of Scottish society faces ridicule and a complete loss of credibility.

    I still expect some kind of Rangers to emerge (and still a spiteful, ugly, brutish manifestation with its supremacist culture of entitlement intact) regardless of the legal, sporting and ethical hurdles to that. I fully expect this entity to be hailed as the same club with the same history.

    The entire episode is a shameful indictment of our nation’s elites, and of the expectations and attitudes of much of its population.

    what i do know is that the deep seated animosity, bitterness and sheer hatred in scotland between the big two (sic) appears to be more ingrained and rooted in beliefs that those espousing them do not even appear to follow i.e. religious beliefs, than any divisions amongst our continental cousins (excuse the cliches…i’m tired and emotionalish)

    a rangers … playing out of ibrox, and living within their means, and without the 17th century baggage would be like manna from heaven for me…

    it might mean i could go and watch celtic without the 20th century baggage…i’m sure you know what i mean!…

  40. If Whyte had this director form since May 2012, why has it only been filed now? Last week he was telling us he told Green not to go ahead with the IPO. So why didnt he reveal he was Sevco before that and kill the share issue dead?

    Why wait till now, when the money is in the bank and many of the institutional investors are close to being able to cash out?

    Nothing today makes me change my mind that this is all part of the plan.

    What has changed recently CW lost the TU case and now owes them around £18mil. Could the plan hatched between CW and CG ( maybe SDM also involved) was if this happened the share
    issue money would cover it, they would then bail out with the balance a small fortune around £4/5 mil and leave the Blue Knights to pick up the pieces. However when CW tries to get CG to cover the debt he refuses because the coffers left are insuffient to cover ( CG admits on the STV interview there is more than £10 mil but less than £20 mil in the bank) . CG then releases some tapes to try to force CG hand ( ergo the blackmail suggestion ) when that does not work he then lodges his “insurance” card with Companies House.
    Interesting to note that the CG statement does not cry forgery, he has not said the signature on the forms is not his, he only uses some wishy washy words in defiance.

    But my intuition is that will not be the reality. In fact of the three it is arguable that Whyte has not actually done anything wrong other than not pay over tax to HMRC. There is a civil sanction for that but the extent to which it may be enforceable can be severely restricted where the individual resides outside the uk.
    The police raids on Thursday were into the original sale of Rangers but of course there were two parties to that transaction and the whole momentum of the deal was driven not by the purchaser.

    GERS chairman Malcolm Murray has called an emergency meeting for before today’s third division match against Clyde at which Green will be asked to reveal his true relationship with the disgraced ex-owner.

    CHARLES Green will be grilled by the Rangers board today and told to reveal his true relationship with disgraced ex-owner Craig Whyte.

    The chief executive is facing D-Day at an emergency meeting called by chairman Malcom Murray amid turmoil at Ibrox over links between the two men.

    Green will be facing questions alongside his boardroom allies Imran Ahmad and Brian Stockbridge. With a power struggle raging at the club, Rangers sources say it is feasible that the rest of the board could decide to terminate the trio’s contract.

    An alternative could be to suspend one, two or all three pending an internal investigation into Green’s connections with Whyte and the racism row the chief executive is embroiled in.

    We understand Murray was holding off on calling the summit until non-executive director Ian Hart returned from holiday in the US.

    Hart will be joined by fellow non-executive directors Walter Smith, motors tycoon Bryan Smart and Phillip Cartmell, the former boss of a security firm.

    They will demand answers from Green before today’s match against Clyde.

    Murray has been working behind the scenes to co-ordinate a strategy following Whyte’s allegations that Green was working for him.

    Green had always denied a connection to the former owner.

    We understand there have been at least two conference calls between Murray and his non-executive directors in the build-up to today’s showdown.

    Their concern at Green’s behaviour was heightened at the start of the week when he admitted using the word “P**i” when addressing his right-hand man Imran Ahmad.

    Green has denied being in partnership with Whyte, claiming he had to deal with him in order to gain control of his shares ahead of a potential CVA when the club went into administration. He admitted “shafting” Whyte when he no longer needed his shares following the liquidation of the Ibrox oldco.

    That admission has prompted an SFA investigation into his Rangers takeover and they have also charged the Yorkshireman with bringing the game into disrepute for his comments about Ahmad.

    If any proof is found to back Whyte’s claim that he was involved in the Rangers takeover, it could have severe consequences for the club.

    Whyte was banned by the SFA from having any involvement in the running of a football club, following the carnage he wreaked during his chaotic spell at Ibrox.

    But before the SFA hearing, the Gers board are demanding clarity from Green, Ahmad and the club’s finance chief Stockbridge.

    It is understood there is a determination from the chairman and majority of
    non-executive directors to take firm action.

    A source close to the crisis said: “Some would say this is D-Day for Green, Ahmad and Stockbridge but without wishing to be too dramatic, it is closer to the truth to say it is D-Day for Rangers.

    “Everything is at stake. Unless they see appropriate action taken, it will a leave a number of the non-execs, Walter Smith included, with no choice but to resign.

    “A through and forensic investigation of what has gone on inside Ibrox needs to be carried out for the good of the club. If the people involved have nothing to hide, then they should have nothing to fear.”

    The move comes as the Rangers Supporters’ Trust called for Green’s future to be decided – and for the Green and Ahmad to pursue legal action against Whyte.

    The fans’ group want Whyte dragged into court to force him to provide evidence backing up his accusations about Green.

    The Trust statement said: “Our club needs clarity over two major issues – the future of Charles Green and the ongoing claims of Craig Whyte.

    “The proper places for these two to be handled are, respectively, the Ibrox boardroom and a court of law.”

    It added that the board have the authority to deal with Green’s “recent performance without interference from the media or external bodies”.

  53. The additional directorships forms for Sevco 5088 which STV have obviously been given by CW present a bit of a conundrum. If the forms were signed in May 2012 it would be logical to think that they were submitted by FFW, But I don’t think that will turn out to be the case and I think it more likely they have been recently submitted by CW or an agent acting for him.

    So does this mean that the forms are counterfeit or in some way fake of fiddled by CW. Not necessarily as there is a relatively simple explanation.

    I really don’t think CW would have been daft enough to sign his holding in rangers over to anyone without some kind of guarantee and as a spiv he knows how foolish it would be to rely on the word of another spiv or spivs especially when we know from Green’s mouth that he would have told CW anything to get his shares – not that I am making any suggestion that Mr Green is a spiv btw.

    So let’s look at what happened last May – It seems clear to me from the CW tapes that it was Green who was in communication with FFW over the legal procedures in setting-up Sevco 5088 and that he personally also paid the legal expenses involved. There is a bit in the STV interview where he says that the money he paid to FFW in respect of Sevco 5088 as ‘legal expenses’ had been run-up by CW and Earley. He is apparently referring to the £25K paid into his bank account. I believe that can’t be correct because Sevco 5088 was a cheap off-the-shelf company so what on earth legal work was required that cost £25K? It just doesn’t ring true.

    But leaving that aside there is no doubt that Green was shown as the only director and shareholder of Sevco 5088 in Companies House records last May. This would also seem to be confirmed by the striking-off application dated December last year and submitted to Companies House by FFW. Tellingly the only director’s signature on that application is that of Green but if CW and Earley were directors then at least one of them was required to sign the striking-off application. The fact that FFW handled this makes me think that they believed their client Green was the only director.

    So Ibrox is right with mutterings there is something wrong with the paperwork produced and possibly even it has been forged. Well perhaps and I will return to what I think is the simple explanation.

    Because the additional director forms could have been completed back in May and perhaps Green gave the completed and signed form/s to Whyte as proof of his goodwill and also to establish a legal claim on Rangers for Whyte should Green walk under the proverbial bus. As I said earlier Whyte would have need some documentary proof and hold over Sevco 5088 because he’s a spiv and he knows what spivs get up to. Again I make no aspersions about Mr Green or any of his associates and their probity.

    In any case we might see a full blown rejection of the additional director forms today or on Monday which would destroy CW’s carefully constructed plot to once again own Rangers. I am not so sure about that because CW has played a blinder so far in having opponents make statements and then destroying them with fresh tapes.

    It may well be that more tapes will follow which flesh-out the scenario I have painted or perhaps CW has documentary proof of the Sevco 5088 resolutions which confirm he and Earley were added as directors abd who knows what else .

    The problem for Green is that I have long suspected that his memory is not his strongest point and he must be racking his brain trying to remember the details of every conversation he or Ahmad had had with CW or what, if any, documentation was handed to him.

    The only thing that is certain is that nothing in this affair is simple or quite as it may appear on the surface.

    Looks to me like we are now in the third act with only the final act to follow follow .

    Far from it. If Murray and Cardigan were forced out then it’s quite likely AIM would react and suspend share dealing and I reckon Murray would be legally obliged to request that move.

    You have to remember that Green and Stockbridge are the two executive directors. Green doesn’t really care a toss about what anyone thinks of him and he seems to regard himself as bomb-proof anyway. But Stockbridge is a different kettle of fish. Much younger and an accountant and he can’t allow any taint to attach itself to him or the smell will never leave him. And he is answerable to professional associations. He will look after himself I am sure of that.

    Now the NEDS – who have legal responsibilities to protect the shareholders – are: Murray, Cardigan and Iain Hart. All Scottish and who live here and who are all Rangers men. They will stick together I reckon.

    That leaves the two ‘institutional’ NEDS brought on board very late in the day obviously to boost institutional investor confidence. I don’t know this for a fact but I have a feeling they are more Murray’s men than Green’s. But even if they are Green’s they both have long records in business and I really can’t see them taking the risk of throwing that away.

    So it could well be that that Green is very isolated – I have a feeling that no vote will actually be taken and a fudge statement issued to get them to the end of the season and Green gets to go with his shares which suits him and everyone else. However, one thing this story has proven is that anything could happen and it is likely to be entirely out of left field so buckle-up and hang on tight because the rise could be bumpy.

    And always remember that Green was never going to be here more than a year anyway – that was his original plan and I have seen nothing that would change it. The party’s over and it’s downhill all the way from here so why hang-about?

    However back to Murray and Whyte

    There were 2 key elements. Equity purchase and settling of Lloyd’s debt.

    The Equity purchase was mooted at around £6 million for a long part of the negotiation , and then mysteriously dropped to £1 when the small tax case was “discovered” Setting aside the fact that the STC was for £4 million and therefore would not impact on the equity purchase by £6 million, I wonder about this last minute change of price

    I doubt very much £6 million was ever on offer and the price was always going to be £1 . Murray had been trying for years to sell, and there were NO BUYERS AT ANY PRICE

    So Whyte did not benefit from a cheap purchase when he paid £1. He paid the market rate , he paid what it was worth

    That takes us to the 2nd element of the deal. The settling of the £18 million to Lloyd’s . Who stood to gain and who stood to lose out of Murray, Whyte and Lloyd’s .

    Well clearly Lloyd’s stood to gain, as they got their money and terminated their relationship with Rangers. So they had motivation to want this to happen. I would be very interested to see what evidence , if any, there is that Lloyd’s played a part in setting up Whyte with Ticketus. My opinion is that no such evidence exists , subject of course to caveating Whyte and his magic tape recorder

    Did Murray stand to gain? You bet he did. He got to offload Rangers before the inevitable liquidation. He also got to sell to a “Billionaire” thanks to the complicity/naivety of his media poodles, and he was able to get his QC to prolong the FTT in order that Rangers went bust on Whyte’s watch. Finally he was able to point Whyte towards Ticketus to fund the money Lloyd’s demanded

    Did Whyte stand to gain. Absolutely, he had no opportunity to complete he deal without the Ticketus money. Nobody was prepared to use their own cash to pay off Lloyd’s , and conventional bank borrowing was unavailable for a variety of reasons including the BTC and the busted nature of the Rangers balance sheet

    Is there evidence of Whyte and Murray conspiring in an illegal manner ? Who knows.What we do know is that both stood to gain significantly and the only way to achieve his was through Ticketus.
    Where there is strong motivation and only one path to a solution , you usually find your answer as to who did what.

    Lend that rationale to Whyte and Greens deal and you fairly readily understand Sevco 5088 and all of the implications

  63. Jackson nicked my Trio gag. Has he no shame? I’m very suspicious about the Record and STV suddenly leading the story, here. The worse Green is portrayed, the lower the benchmark for the new emperor. If it’s another spiv, will Chris Graham tell us he’s more trustworthy than Green? Get the nasty man out and all will be fine.

    What deadline did the SFA put on their request for “clarification” from Green? The end of the season? The 32nd of Julember? If he goes, does the request get withdrawn and we all forget about it? Maybe another disrepute censure will teach him a lesson and avoid suspending or withdrawing the Club’s membership, which may have been gained by deception? If the membership is questionable, what about the financial guarantee that should protect the SFL and it’s clubs?

    With the assets rumoured to be owned in the Far East, what is the betting there could have been other shenanigans at Ibrox? This cake has many layers. Is there a topping involved? That was some lead Rangers lost last season. Just thinking out loud after a caffeine hit.

    The MSM are so off the pace and even now are focussing on “emergency board meetings” rather than just getting tore in and asking the questions that all football fans including Rangers fans need to know.

    And here’s a wee clue guys. Don’t just target Charlie, thats fun and easy right now but it is only a small part of the answer.

    Looking back is another clue and as HP said on this site don’t accept so many coincidences at face value.

    Good point, but the revaluation would almost certainly have taken place after the properties were transferred to RIFC. The properties would have been transferred at cost at the earliest possible date. So I would guess that the price (and debt) would have been around £4m, or whatever the price was in the sale agreement with D&P.

At the board meeting today Charles will explain to them all exactly what happened with the signing of the documents.He was forced into a corner at the time and having to sign he signed with his left hand ,I normaly sign with my right hand and felt in doing this I knew in my mind the documents would not be legal ,I never bothered to tell anyone this as I could not trust the man to come back with something else,here give me a pen and I will show you both my signatures,now onto the second item on the agenda,blah blah blah etc


  68. Considering the filing of new documents at companies house re directorships and change of corporate address, I find myself asking the question.

    Who was responsible for filing these documents? In this instance it would be my gut instinct to say that Green and FFW were responsible for filing as they were the existing director and filing agent. CW signs in good faith expecting that the existing director and legal agent who were probably in the room as co signee and witness would file their copies. I’m going to say that I’d expect that these documents were signed in triplicate (one for green,whyte and one for filing).
    Therefore CW can easily explain the delay in filing.

    Can any of the legal beagles correct me?

    Hope you’re not too disappointed but radio 4 has just talked about it and mentioned that in Scotland there’s “a Scottish LEAGUE Cup semi final on today”.

    The Buddies have already lifted that!

    Heard that too,
    BBC UK Sport only find time for one sentence about Scottish Football in their main bulletin and even then, manage to get it wrong.
    Annoying though it was, at least they got it wrong through disinterest as opposed to their counterparts up here who usually do it through dishonesty.
