Mr Green and Opportunity Knocks— For Aberdeen?

Good Morning,

In the last week, we have seen a number of strange occurrences in Scottish Football, which if taken together might just point to a very different land than the one we were lead to believe we live in just two short years ago.

First of all there was the report from a firm of well known accountants which pronounced that a significant number of Scottish Football Clubs had, in fact, sold more season tickets for this coming season than they had in the course of the last several years.

Then we had the spectacle of the National team travelling to Wembley and playing very well AND being cheered on by a very large travelling support who appear to have been full of fun and who acquitted themselves well in the big smoke.

This morning I read that today’s match at Pittodrie is a sell out — with the old stadium being packed to the rafters for the visit of Celtic. This is the first time that Aberdeen have been able to sell out the fixture for some 6 years!

Not only that, various Celtic supporting websites have lead with articles saying that the return of a strong Aberdeen and Dundee United are to be welcomed– in fact not only welcomed but positively wished for.

In contrast, stories abound about the in fighting on the Ibrox Board. There are surreptitious share dealings and all sorts of company jockeying being deployed by the rival factions who are trying to gain control of The Rangers. Further, there is the suggestion from some well informed parties that not only will Ibrox and the Albion be sold and leased back to the club to generate much needed immediate cash, but that Murray Park has been sold off completely and will no longer be available to The Rangers for any purpose whatsoever!

Clearly, there are big troubles at the club which will not assist in the stated intention of rising to the very top in Scottish Football.

In between all of this, the debate goes on about Campbell Ogilvie, Press manipulation, the correspondence  between Media House and the SFA, and between The SFA and Ibrox re the relationship between Charlie Green and Craig Whyte and so on.

Standing with my business hat on, I looked at all of this and wondered what it all meant, and pretty quickly reached the conclusion that we are now in a time of supreme opportunity for some of the clubs in Scottish Football—- particularly Aberdeen FC.

There is a view abroad, that in the absence of the “Strong Rangers” that Celtic Football Club will win the SPFL title for almost evermore — or at least until they are toppled from the top spot by the rise of a strong Rangers club somewhere towards the end of this decade or early in the next– because we are assured that they will be back– in one form or another– in a rather Arnold Schwarzenegger  like fashion.

That return or initial rise if you like– its timing and its manner— is dependent on a number of things– not least the exit strategy of Charlie Green and his cohorts.

If it is true that The Rangers are going to part company with Ibrox and the Albion, that they have taken on a loan of funds which attract a rate of interest that amounts to 15% per annum, and that there are set figures for buying the old ( and decaying ) stadium back any time soon, and that they have yet again hawked the season ticket money, then the already flawed Ibrox business plan is burdened even more by interest and rent payments of an additional £3M per annum and rising!

It should also be noted that the accounts for old co from the mid naughties onwards boasted that season ticket sales, merchandising, corporate hospitality and so on had reached unprecedented levels—- but—- the club still did not make an operating profit without strange internals transactions such as the repurchase of media rights which added £15M on to the P&L’s AND the sale of Jean Alain Boomsong!

Accordingly, the current position will not make for good financial reading.

So– let’s presume that in the current climate Celtic are out of sight and will always be champions for ever and a day. What do the rest of the clubs say in the absence of the Ibrox club without whom they have been told they will perish?

Well, If I were in charge of Aberdeen FC I would look out across a city with an inherent population of some 220,000 souls sitting in a county which takes the population up by another 40,000 or so. I would note that the compact city also houses two universities and a number of colleges — all of which attract visitors to the city— and that its position as the oil capital of Europe also draws in a substantial number of itinerant workers.

Further, personal knowledge shows that many who studied at Aberdeen University or Robert Gordon’s in the 80’s left the city as Aberdeen FC fans and no matter where they have ended up in life they still make the journey back to Pittodrie when they can– especially in good times!

Alas, however, Aberdeen has not enjoyed ” Good Times” of late— in fact not really since ……….. the arrival of David Murray at Ibrox!

If you cast your mind back to the pre Murray era, Aberdeen were a force not only in Scotland but Europe as the recent nostalgia re Gothenburg has reminded us.

The city has an economic micro climate which suggests that it can ride economic hardship better than most and so all things considered this current period provides a great opportunity for the Dons.

Unlike Dundee United, Hearts, and Hibs, Aberdeen FC sits in a large one team conurbation and should be on the doorstep of a populace which can fill Pittodrie every single week …… IF that fan base can be motivated.

And there lies the rub– how do you get a notoriously fickle fan base out of the armchair and into the stadium?

The late Bob Crampsey once described Pittodrie by saying ” And there are the masses of Aberdeen fans, masquerading as rows and rows of Empty seats!” yet in their heydey an Aberdeen crowd on a visit to Glasgow were among the noisiest– and to this football fans eyes — the scariest ( in a good sense ) supports to be seen.

Well, at this juncture, Derek McInnes and team need only look at every other football club in the land ( bar Celtic ) and determine that come next May those others will be below them in the league. If Aberdeen maintain a strong league run keeping everyone behind them then there is the possibility of a huge revenue swing in favour of the Dons– such a swing that would put them in an even stronger position for the following year.

Further, Aberdeen are a European name. Perhaps a European name from yesteryear and not the recent past, but the pedigree is there and as such there will be those who remember the heady European Nights both home and away. Reviving those memories and that reputation– at least to an extent– is not beyond the club, and with no disrespect to Motherwell and St Johnstone both of whom are liable to lose key players or even a manager between seasons, Aberdeen may just be of a size to consolidate each year rather than scramble to maintain the momentum of one good season which comes along every now and then.

Financial management and football rewards can go hand in hand when combined properly, and of all the clubs in Scotland who can benefit from a level playing field in terms of proper football governance, Aberdeen FC are uniquely placed in my opinion.

That is not so say that The Arabs, or the Hibees or anyone else cannot benefit– on the contrary— but the Dons are the most obvious candidates in terms of potential structure to really motor forward and regain a by gone status.

Such a situation, and the recognition of that potential, should be borne in mind by all at Celtic Football Club, as last year they struggled for a period in the league while they concentrated on their European exploits. If Celtic want to go further and further in Europe ( and why shouldn’t they ) they will have to be wary of any club which is capable of reigniting its fortunes from a lowly position or a position of having to look back at glory and potential glory rather than looking forward.

Further, with the way things are being organised at Ibrox, there is absolutely no guarantee ( some would say likelihood ) that an eventual challenge to a perceived dominance by Celtic will come from that quarter, and life in the top flight for any returning Rangers could prove very difficult if the likes of Aberdeen get their act together and start to produce the type of home grown team of old.

For now, I sense a degree of optimism about the Dons– not just on the playing front either.  They have a fan base, they have a business model and a good young manager, and any comparative business exercise must conclude that they have every chance of rising above most of their rivals in the league, in terms of revenue, in terms of brand development and business expansion.

If I were an Aberdeen fan I would like to think positive and be ambitious in this climate, whilst at the same time casting an eye back to the days when they were top of the tree.

As one Aberdeen supporting ( but now Edinburgh based ) friend put it to me:

” Ah, those were the days my friend, those were the days……………”

  6. I’ve never understood the reluctance of so many people, who claim to know devastating details, to NOT publish their information.
    I remember the days when the media used to attempt to scoop each other with stories before their competitors got wind of the story.
    Here however we have a stand off, of people who claim to seek the truth, and indeed know it but simply refuse to print it.
    This may be a very contentious statement but they are not helping the situation. They are indeed part of the problem.
    The litany of hints on ‘The Rangers’ and its many would be saviours along with the SFA of details that will bring the house down are now almost too many to count.
    The truth in this scandal really is the casualty as the news industry slowly stifles, turns a blind eye, and indeed abandons the story.
    How can this be in the public interest?
    How can people form a reasonable opinion on something if the truth is buried deeper than a pharaoh. This story is no longer within the comfy confines of Scotland. It, if seems true, has been side lined or buried by C4 news despite the reporter actually filming outside Ibrox before the story was pulled.
    Police investigations are even more pathetic as they crawl in reverse away from the truth. Indeed investigations into the people who wish to release the truth appear to move quicker than the investigations into the issues they reveal.

    I think it is about trust but you need to know someone before you can trust them. Or at least you can never trust them until you get to know them.

    The world is full of disinformation that seeks to divide us all. Sometimes you just have to go on gut instinct and sometimes as a result you are wrong.

    It does seem to be a very personal message.

    It’s difficult to work out why Jack Irvine would be suggesting using them, with their knowledge and contacts.     With regard the jail sentence, it is my understanding that relates to whether or not he pays the fine, as opposed to the tax bill. If two years in jail expunged the £44m bill I think most people would seriously consider doing the jail time instead.

    I’m no expert, far from it in fact, but I would counter that 44m (is it R or £??) would be considered by many to be an acceptable hit when faced with with a Pretorian or Joburg jail. A cushy, open penal facility? I very much doubt it!

    Scottish football needs definitive guidance.

    Kind of academic, the prison sentence was an alternative to paying the fine rather than the principal sum.

    The doing 2 years in jail rather than paying over £44m was said very much with tongue in cheek. That really wasn’t ever an option.

    In case you refer to JI tweet – for starters …… JI talks of (allegedly) passing payment to a SARS agent in return for secret government files.
    The US government take such action (including bribery of foreign officials ….extremely seriously…. Extremely … Especially, If conducted by a company operating in the US.

  14. I was just writing a rambling post on my feelings about where Charlotte’s revelations might lead, but gave up as it seemed a bit far fetched. Then I read the posts lamenting C4’s dumping of the story and realised maybe it wasn’t so far fetched after all. Earlier I just had the feeling that it was all going to fritter out, or produce evidence of wrongdoing, and cover-ups, in higher echelons than Ibrox or the SFA. The sudden loss of interest by Mark Daly and Alex Thomson, with the story only quarter, not even half, told or played out, always seemed strange. As though these quite intrepid reporters suddenly took cold feet. AT’s apparent acceptance that CF’s tweets were off limits due to possible legal problems just didn’t ring true for a man who normally likes to tilt at more than windmills. A few mainstream writers have tried to question this reticence but without pushing it out mainstream, and have made no attempt themselves to investigate the story. On C4, they’ve made programmes that really pushed the boundaries and crossed taboos, and yet, with a leading investigative journalist seemingly fascinated by the goings on at Rangers, they seemed to drop their interest just as things got beyond football shenanigans. CT seems to have incredible access to many Rangers documents and she also seems to be revealing things from an ever widening circle. So I find myself wondering, are the authorities after her? Is she after the authorities? Or is she the authorities? Or am I havering and is it, as I suggested as an alternative, just all going to fritter out?

    Thankfully the East Fife players have tomorrow off before work on Monday so they will probably be relaxing as well. Unless some of them have a Sunday shift with their full time jobs of course.

I know this isnt the accountant helpline but hoping some of the accountants can help me out,i have a facility which allows me to owe as much as 34 million pounds if I owe say 10 million at close of business today I would be paying 1.5 percent interest on this amount. I have lets say another ten million in an account which pays me more than 1.5 percent interest and I’m expecting this amount to grow .help what should I do.


  23. I have sympathy for fergussingstheblues’s comments. It is very frustrating that no authority, other clubs or news professionals seem to have the cojones to tackle the scandalous behaviour down Hampden and Ibrox way.

    If it is the case that some folk are put off by too much of a CFC agenda on this site, then those CFC fans posting should maybe consider the implications.

    We are too few to afford alienating friends and allies, actual or potential.

    Yeah, sure did mate. This is my last night on this. Just had to have a good rant, although I know the mods will soon remove it, as I’ve critiscised both CFC and TSFM. Didn’t take all that long to type anyway. I’ve got a good keyboard, it’s neutral and unbiased!

    Maybe RyanGosling should invest in one as well. When TRFC go bust again, Ryan can write with a bit more contrition as to his teams predicament, whatever team he thinks he supports!

    Come to think of it, what are they called these days? It’s definately not “Rangers”. They died last year if I’m not corrected.

    mmmmmm!! Oh! I forgot, “The” Rangers, or is it “Sevco”, or is it “Sevco88” or “Charlie’s Ltd” or “Craig’s Retirement Fund United” ? Maybe even “Easdales Eagles” (see, good franchise name!).

    At least, Ryan, The East Fife players will go to their beds tonight in the knowledge that they’ve worked hard and payed their due to the Taxman.

To my mind you are one of the stalwarts on here and the dedication, commitment and tenacity you have shown thus far is not only commendable and to be lauded but should be held up as an example.     I would love to see Mr Reagan knock on his “President’s” door somewhere in Hampden and say” Hi Campbell, We’ve gave it a good go. It’s maybe time you retired so we can clean this mess up. It’s quite difficult whilst you’re still here. Don’t worry, We’ll give you a good payout to repay your EBT”

    Seriously Folks, this guy we affectionally call “CO” has been under the radar for years. He is seriously compromised in this whole scandal, yet still holds the position of “President of the Scottish Football Association” ! Just about sums it up for me !

    If the guy had any Baws, he would have walked from this Saga 2 years ago, Even more worrying, why hasn’t Mr Regean been knocking on his door asking him to retire ?

    More disturbingly, why is Mr Ogilvie never seen on TV ? I couldn’t even tell you what he looks like ! Closest I got was when Tommy caught him in a phone call. He came across as a guy who didn’t care / or didn’t give a hoot what people thought.

    Why is “CO” allowed so much leeway ? One of life’s great mystery’s I suppose ?

    Scottish Football needs a good “Cleansing” from Top to bottom. Messr’s Doncaster & Longmuir are not qualified to to it, as they are only interested in profit.

    However, Mr Reagan is the guy in charge at the moment of “Scottish Football”. He’s been very quiet as well !!!!!!!!!

    What a mess ?

    BTW, never my intention on aiming to go down in a blaze of glory. Actually going down with a sense of disappointment with TSFM, and a real heart felt sorrow for the decline of Scottish Football.

    Way back then, supporters were King. Nowadays, supporters are just Cash Cows!. I used to have loyalty back then, as it went both ways.

    In the present time? Loyalty is a dirty word inside football circles. It’s only ever used by “Your” Football Club when they want “your” money.

    Football in Scotland has been going down the pan for a good few years now. Desperate Clubs are shamelessly relying on the “loyalty” of their dwindling support. I’m afraid that many people are now turning their backs on Football. It’s a dwindling business with a dwindling support.

    It’s not the same as it used to be, thats why I’m offski. And yes Tif Finn, unlike McCoist, I am walking away now, finally.

A while back I asked a very prominent Sportswriter why his newspaper condemned large scale tax evasion on the front page while demanding it be overlooked on the back page. His view was the same old tired line about Rangers importance to Scottish society etc, with the claim that Celtic ‘would receive exactly the same coverage’. Personally I believe Celtic would have been treated very differently but that’s only my view. So in terms of Charlotte they have clearly decided that to pursue the information may take them to a place which puts Rangers, The Rangers, Sevco, whatever, in an untenable position and they simply don’t want to do that. Furthermore, there is great potential to unveil scandals that may involve many establishment figures and many traditional Rangers men they placed on a pedestal decades ago. Like many people they simply don’t want to ask the question because they have a great fear of the answer.

    It is all really quite incredible. It’s hypothetical, but imagine something similar had happened in England with a major club. Does anyone really think the English media would sit in compliant silence with so much information being handed to them on a plate?

    You have probably summed up the media attitude very well in this post. Extremely well, in fact. Much has been said over the past two years about the media inactivity, which in itself is a story, but they seem to be ingrained with a belief that ‘Rangers’ are important within whatever makes up Scottish society. They, the hype purveyors, believe the hype! They have undoubtedly convinced themselves they are doing Scotland, not just football, a favour. Rangers are dead, but the media, like the bears, cannot bring themselves to believe it. And if Rangers evaded tax for all those years, they couldn’t have been such a great part of the ‘fabric’ as many would like to believe. Best to leave it alone then, and maintain that belief!

    THE REGISTRATION EMBAGO

    “The Registraion embago” means a prohibition on RFC, Sevco and Rangers FC from seeking registration with the SFA of any player not at 0.01am on 1st September 2012 with or employed by RFC and/or Sevco excluding any player under the age of 18 years for a period of 12 months from and including 1st September 2012 expiring at midnight on 31st August 2013, it being acknowledged that:

    (a) Players on loan by RFC, Sevco and Rangers FC to other clubs within Scotland are still contracted to their principal club and are accordingly “currently with the club” and their registration revival upon expiry of the loan agreement is not struck as by the sanction.

    (b) Players on loan to other clubs outwith Scotland are still employees of their principal club with whom they maintain a contract of employment. They are accordingly “currently with the club” and re-registration at the conclusion of the loan agreement is not struck at by the sanction.

    (c) Current players may have their contracts extended prior to expiry of current contracts and their registrations renewed accordingly.

    (d) If a current player’s contract expires and his registration expires, but he was nonetheless registered to the club at the time the sanction takes effect (i.e. 0.01am on 1st September 2012), then he may accordingly be re-registered at any time in the future.

    (e) The club may not register any player after his 18th birthday who is not already “currently with the club” under a contract of employment or registration.

    The expressions “currently with the club” or “current player” shall be deemed to be assessed as at 0.01am on 1st September 2012

  43. Rangers were an important element of Scottish society (not a good one, in my opinion, owing to signing policies and its undue influence on the people meant to be running football). Scottish football was bigger (bigger crowds, more money) and more competitive before Rangers went into liquidation. You can understand why people who care about money and presenting a business case to television companies and sponsors and so on would feel nostalgia for the bad old days.

    But it’s no one else’s fault that Rangers went into liquidation. Only theirs. And the extra money and the extra competitiveness are not worth turning a blind eye to what the liquidated club did. Not worth it at all. Not in a million years.

    It would depend on ones interpretation of ‘important’ whether or not we might see Rangers as an important element of Scottish society. To me, important, in this context, means meaningful, necessary and worthy, and though meaningful to a large section of our society, it is very debatable (or maybe not really debatable) whether or not their ‘meaning’ is desirable within any society. Had Rangers not existed, and nothing existed of a similar ilk, there is no doubt that society would not have suffered in the least, and might (probably would) have been better. For a century Rangers were a focal point for the unjustified hatred of one section of our society, for a decade they cheated the taxman and left many honest elements (though perhaps not considered important) of our society unpaid – all while claiming some high-ground of dignity. The new club has carried forward the mantle of hatred and lack of fiscal morals and are allowed to get away with it because of some skewed belief that they are important. If Rangers are an important element of Scottish society, I am glad that I do not make it to that lofty status.

  46. Just read back and came across the posts from “fergussingstheblues” – the poster who speaks “On behalf of all Non-OF supporters” (his words).

    Not sure if that particular demographic are ok with that, however, reading between the lines, I assume that makes me an OF supporter?

    Two points. Firstly, the “Old Firm” does not exist now as one of the participants spent other people’s money until they self-combusted. Secondly, when it was recognised as being in existence, no-one I know “supported” it. I accept he probably didn’t mean that in this sense, however it’s all to easily quoted in a pejorative way and I for one find it quite insulting.

    That said, in reading his long final post, and the ones which followed from him 😉 , I was reminded of a piece of advice my dad (god rest his soul) regularly gave me; “you should never make important decisions when you’ve been drinking that you’ll probably regret in the morning”. Wise man he was.

    Fergus will now have to change his moniker and his IP address to re-engage.

    A lesson to us all.

    You’re right of course, but some posters give opinions without a shred of evidence, and I just can’t help myself.

    The latest attack on Celtic being deeply in debt is down to wishful thinking.

    I would respect such views if they were backed up by hard evidence, and indeed be concerned, but it seems to me at the moment that such allegations are based on ‘wouldn’t it be great if’ emotions.

    However, I take your point, and promise to TRY to be a good bhoy.

    With respect to…‘keeping pressure on the governing bodies of our game and on the media for not reporting the truth, because if this goes on unchecked nothing will change.

    I have nothing but admiration for your faith that this course of action will have any effect whatsoever.

    The last two to three years show that the governing bodies and media are hell bent on supporting the Rangers Tribute Act come hell or high water.

    If Sevco survive it will be back to business as usual.

    Others have pointed out their many transgressions since liquidation.

    They have shown NO interest in apologising for the offences they have committed, never mind showing any indication that they are prepared to change.

    In my opinion the only salvation for Scottish football is if they go out of business permanently.

    He said: “Alistair [McCoist, the club manager] has said he is going to talk about his pay package. We have had discussions on this and these are ­ongoing. He is very open-minded and positive about change, about addressing that. I have done the same.”

    Charlotte if indeed you are accepting requests I wonder if there is anything in your collection that details contact and inter-reaction between Mather and Green or anyone else in the Green camp.

    Mather seems to be confused as to whether he knew Green prior to becoming involved with Rangers and in a major newspaper in The Herald says he had no prior involvement with Green. However a year ago in a BBC interview he admitted to certain involvement with Green and mutual acquaintances.

    It’s just that I can’t help wonder why a Nottingham-based businessman end-up involved with Rangers with a 1 or 2 million TRFCL shareholding pre-flotation if he had no previous contact with Green.

    Maximillian (Max) Metzel, aged 24, describes himself as the Director of Football of Simply Sport Management and a Players’ Agent Licensed by the English FA. He attended Durham University and holds a master’s degree of laws and a bachelor’s degree in business management and FA coaching qualifications and he may be able to provide some welcome support for Sally.

    He started out working in the computer games industry and then became an agent in the entertainment industry agent before switching to sport management in 2009 becoming a director at SIMPLY SPORT MANAGEMENT LIMITED in January this year.

    Sound a last post for another fallen contributor. This saga has certainly taken its toll and I have questioned my own participation on a number of occasions. Despite fergus’ dismay I think he will now carry with him a new outlook. If nothing else the discussions may have provided an alternative perspective and opened up the possibility of considering ‘facts’ from different angles.

    Fatigue is a symptom of expended effort and though our fallen colleague may feel that his tribulations have been in vain it will be history that is the final arbiter. It cannot be known presently how much, if at all, the political landscape has changed. I’m sure his words will strike a chord with many.

    It would be easy to say that to give up offers an easy victory to the opposition but it would be equally trite not to recognise that an erosion of sentiment is a reality when you are trying to bring about change. Rather than be scathing of an expended effort better to recognise a contribution and be thankful that so many have been and will continue to be willing to engage.

    Enjoy your golf fergus. Strike the ball truer than you have ever struck it before and examine every lie and possible route of escape more keenly than ever before.

    Is this the kind of revelations of cover-ups that some in authority, outside of football, might fear from Charlotte Fakes? Is there perhaps documents in her possession that show a decided lack of ‘good faith’ in this decision to divert charity money to Rangers (IA), that might, once revealed, highlight how inept the OSCR are? Is there documentary evidence that would suggest less than honest efforts to save Rangers have been made by agencies outside of the SFA and other football bodies? Once again, an organisation charged with insuring that laws and regulations are maintained, have, despite finding guilt, come up with a spurious excuse not to punish those conspiring to save Rangers.

    Corsica Charity has clearly worked tirelessly to publicise this disgracefully inept inquiry into the diversion of Charity funds – done solely with the intention of ‘saving’ Rangers. What a pity no mainstream journalist appears willing to take up the mantle. This should, indeed must, be publicised and the OSCR brought to account; for unless this happens, how can the public have ‘good faith’ in the oversight of all charities, and so continue to contribute to them?

    As with many from Ibrox their words must be put through the microscope. Because Green has said that he didn’t sign it doesn’t mean it wasn’t signed by someone else acting for TRFCL 😕

    But the RIFC Plc flotation Prospectus makes it clear that whether signed or not that the 5-way agreement was accepted and entered into by TRFCL. If it wasn’t then this is another one for newtz to add to his list of AIM Prospectus irregularities.

    I’ve copied a couple of bits from the RIFC Plc AIM Prospectus for background:

    ‘Further to an agreement between the SFA, SPL, SFL, RFC 2012 plc and the Company dated 27 July 2012 (the principal terms of which are summarised in paragraph 12.1.7 of Part XIII of this document (the “5 Way Agreement”).’

    ‘Following completion of the 5 Way Agreement it was confirmed by SFA, SPL and SFL that the Club would form part of Division 3 of the SFL.’

    ‘12.1.7 5 Way Agreement between SFA, SFL, SPL, RFC 2012 plc and RFCL
    The SFA, SPL, SFL, RFC 2012 plc and RFCL entered into an agreement dated 27 July 2012
    (the “5 Way Agreement”).’

    It would be handy btw if you have a link to what Green said exactly re ‘not signing’ just out of interest.

    Can I just make a few points to the SFA before this happens, nothing new just re-iterating things.

    a, Dave King was a director of Rangers for years before it went into administration and then liquidation.

    b, Dave King cheated on taxes for many years, ultimately agreeing to pay the equivalent of c£45m to the authorities.

    c, This included a fine, with the alternative to the fine being 2 years in prison.

    d, Dave King was also charged with numerous other offences including fraud, racketeering and money laundering.

    e, Dave King was described by a Judge, in Court as a glib and shameless liar.

    Dave King is not a fit and proper person. He is a thief and a liar. That has been proven.

I have always wondered why secrecy needed to surround the 5-way Agreement and was continually drawn to a passage in the RIFC Plc AIM Flotation document which stated: ‘RFCL also agreed to release the SFA, SPL and SFL and their directors and officers from all claims connected with their conduct, the registration embargo and the obligations under the 5 Way Agreement. Further, RFCL agreed to procure that its directors and officers will not commence any proceedings in this connection.’

    The draft released by CF reveals something I don’t think I’ve spotted before under Waiver of Claims 12.2:

    ‘. . . Sevco and RFC hereby undertakes that it shall not, and will procure that its respective directors, associated companies, shareholders, officers and in the case of Sevco those of its directors who are shareholders (in that capacity) and Mr Richard Hughes (as a shareholder) shall not commence, or threaten to commence, any proceedings in any jurisdiction before any court, arbitration or other similar judicial body against the Released Parties (including byway of third party claims in any other action) arising out of or connected, whether directly or indirectly, with any of the Claims or any other matter addressed in this Agreement.’

    So we are back to what happened that could have led to legal action from ‘Rangers’ against the SFA, SPL and SFL and their directors and officers. And how is Richard Hughes the MD of Zeus Capital, whom Ahmad and Stockbridge worked for, involved?

    I think we are missing the subtext in the 5-way Agreement. We know it’s there, we know it is serious but we have yet to see it.

    We even have a confidentiality clause as follows: 8. ANNOUNCEMENTS AND CONFIDENTIALITY

    ‘8.1 Neither RFC nor Sevco may make any disclosure to a third party, press release or publicannouncement whatsoever about, concerning or relating to this Agreement and/or thetransactions contemplated by it or disclose any of the terms of this Agreement.’

    But I don’t see anything in the Agreement, as printed, that requires a confidentiality clause – so the unwritten subtext is what has to be kept confidential. So what exactly is the dirty BIG secret at the heart of the 5-way Agreement ❓

    The correspondence referred to was an e:mail from Biggart Baillie to Brian Stockbridge dated 25 June 2012. The message requests additional information from Rangers which Charlotte suspects was part of the five way agreement. 20 stipulations are mentioned as follows :

    1. An explanation of the relationship between the two Sevco companies (and indeed any other Sevco companies) and any common ownership.

    2. Statement of roles and responsibilities of directors of Sevco.

    3. Fuller CV’s for all directors. I don’t I have seen one for Charles at all. I think no more than a page will do. and a key part is a detailed and specific career history and specific career history with qualifications and name and address of two referees for each director with specification of relationship with the director.

    4. Governance policy.

    5. Organogram including senior management.

    6. “Full details” of all Sevco shareholders. I have names and percentages. I know that you will be keen to keep addresses confidential but perhaps we could confirm the occupation of the individual investors. This is the one the SFA are most concerned about (they appear to be convinced that one of the shareholders is Craig Whyte in disguise). The more information we can give the better. The “nature” of the investment needs to be specified.

    7. Memo and arts.

    8. Confirmation that no director or shareholder owns shares or has any other form interest in any other football club. This includes institutional investors.

    9. Independent confirmation regarding AMLV procedures in relation to equity subscriptions and other financial investments.

    10. Full details of all loans advanced to Sevco including copies of all loan agreements or instruments of loan, interest rates, redemption entitlement and conversion rights.

    11. Narrative 5 year plan.

    12. Employment strategy.

    13. Marketing strategy.

    14. On field objectives (I know – to win football matches)

    15. Proposals re tenure of Murray Park and Ibrox.

    16. Digital initiatives.

    17. Plans for supporter shareholding, flotation plans.

    18. Details of working capital arrangements including providers and conditions etc.

    19. Required player replacement proposals (one for Andrew).

    20. Proposals to meet debts of Old Co to Rapid Vienna, Hearts, DUFC and other footballing debts.

    I can see in some ways why you might want to attend games against them, as it doubtless there is enough material to keep highly amusing chants for an entire 90 minutes.
    However, a complete boycott (meaning that wherever they go “The Rangers” supporters are met my a stadium completely empty on 3 sides – albeit that would be nothing new at Rugby Park – sorry Killie fans) would totally take their wind out of their sails and deprive them of the “oxygen” of confrontation that they thrive on. It would also send out a clear message which would be impossible for the media and authorities to ignore. Pittodrie full to the rafters with 16000 Aberdeen fans chanting “tax dodging b.stards” etc (I’m sure they could come up with better than that) and other chants for 90 minutes would have the MSM drooling over the great atmosphere generated by “rangers” return..i.e.business as usual. I would argue that by attending any games involving The Rangers you would be “turning the other cheek”, as you out it. Arranging and carrying through a mass boycott of all their games unless and until the truth about their formation date and honours list is acknowledged, would in fact be taking a stand against the disgraceful antics we spend hours of our lives discussing on this blog.

  67. I try not to reply too much to moderation complaints publicly, but in the case of fergussingsthebues, an exception has to be made. As briefly as possible;

    A few of Fergus’s posts were removed several days ago and concerned a spat between he and Brenda. Brenda will confirm that her posts, which did not contain direct insults like Fergus’s, were also removed.

    As far as we can infer from explicit and implicit loyalties on here, around 40% of regular posters are Celtic fans. That figure is down on earlier polls. I assume because of an increasing realisation that TSFM is not a Celtic exclusive forum. On the other hand, around 80% of posts which are removed – and 90% of those who have been in moderation from time to time – are (again as far as we can tell) Celtic fans.

    The charge (of Celtic-bias on the part of the mods) is simply not true and is I hope born of frustration rather than a device to unsettle the blog and drive a wedge between the various partisan groups which have been up to now pretty much united.

    Fergus’s post (the very long valedictory one) has been moved to the Moderation Thread.
