Past the Event Horizon

On the Old Club vs New Club (OCNC) debate, the SFA’s silence has been arguably the most damaging factor with respect to the future of the game. Of course people get frustrated when there is a deliberate policy of silence on the part of the SFA which results in the endless cycle of arguments being trotted out again and again with no resolution or closure possible.

The irony (it’s only irony if you assume that the SFA have gone to great lengths to create the conditions for the unbroken history status of the new club) is that the mealy-mouthed attitude they have adopted has actually polarised opinion in a far more serious and irreconcilable way than had they just made a clear statement when Sevco were handed SFA membership. A bit of leadership, with a decision either way at that time would have spiked a lot of OCNC guns very early on, but as history shows, they were afraid of a backlash from wherever it came.

I am now convinced that Scottish Football has passed the Event Horizon and is broken beyond the possibility of any repair that might have taken it back to its pre-2010 condition. Rangers fans will never – no matter what any eventual pronouncement from Hampden may be – accept that their next trophy will be their first. The trouble is that no-one else – again despite anything from Hampden – will cast them as anything else other than a new club who were given a free passage into the higher echelons of the game. Furthermore, they will forever force that down the throats of Rangers fans whenever and wherever they play. A recipe for discord, threats of violence, actual violence, and a general ramping up of the sectarian gas that we had all hoped, only a year or so ago, was to be set to an all-time low peep.

There is a saying in politics that we get the government we deserve. It works both ways though, and the SFA will get the audience it deserves. In actual fact it is the one it has actively sought over the last couple of years, for they have tacitly (and even perhaps explicitly) admitted that Scottish Football is a dish best served garnished with sectarianism. They have effectively told us that without it, the game cannot flourish, and they stick to that fallacy even although the empirical evidence of the past year indicates otherwise.

That belief is an intellectual black-hole they have now thrust the game into. They have effectively said that only two clubs actually matter in Scottish football. The crazy thing is that to put their plans into action they have successfully persuaded enough of the other clubs to jump into the chasm and hence vote themselves into irrelevance and permanent semi-obscurity.

That belief is also shared by the majority in the MSM, who despite their lofty, self-righteous and ostensibly anti-sectarian stance, have done everything they can to stir the hornet’s nest in the interests of greater sales.
Act as an unpaid wing of a PR company, check nothing, ask nothing, help to create unrest, and then tut-tut away indignantly like Monty Python Pepperpots when people take them to task.

Consequently the victims of all the wrongdoing (creditors and clubs) walk away without any redress or compensation for the loss of income and opportunity (and history) – stripped of any pride and dignity since they do so in the full knowledge of what has happened. But even as they wipe away the sand kicked in their faces, those clubs still insist on the loyalty of their own fanbases, the same fans whose trust they have betrayed with their meek acceptance of the new, old order.

The kinder interpretation of the impotence of the clubs is that they want to avoid the hassle and move on, the more cynical view that they are interested only in money, not people. In either case, sporting integrity, in the words of Lord Traynor of Winhall (Airdrie, not Vermont), is “crap”.

The question is; which constituency of 21st century Scotland subscribes to that 17th century paradigm?
Sadly, this massive hoax, this gigantic insult to our collective intelligence, is working. Many will leave the game – many already have in view of the spineless absence of intervention from their own clubs – but many, many more will stay and support the charade.

If you doubt my prediction, ask yourself how many tickets will be unsold the first time the New Rangers play Celtic at Parkhead? That my friends will be final imprimatur of authenticity on just exactly who New Rangers are, no matter the proclamations of both sides of the OCNC argument.

    I wouldn’t expect Wiggins/Froome/the Sky Cycling Team to hand over their yellow jerseys (won honestly by blood, sweat, athletic prowess and skill) just because the company Directors, operating the Sky Cycling Team, had been running a tax scheme that broke UCI rules/possibly the law of the land.

    Perhaps Wiggins/Froome wouldn’t even have been at the Sky Team if not for those salaries, fuelled by the company’s tax scheme, was not in place. It still wouldn’t detract from the achievement of the Team who worked so hard to achieve their goals.

    I’d expect the individuals responsible to be held to account, punishments applied that were proportionate and had least effect on those not responsible for instigating any rule-breaking. But stripping sporting honours, won by the Sports’ team not morally accountable for their owners actions, no, for that is punishing the innocent for the crimes of the guilty.

    That is the reasoning I use to justify my position with regards Rangers Football Club.

    The moral contortions in this short piece are wonderful. The above suggests that you know exactly what happened and you think that it was wrong. You then go on to reach a bizarre conclusion completely at odds with what you’ve described. Are you a Law Lord? A Celtic supporter winding us up?

    Yes, that is why I stated exactly that in the very post you were purporting to respond to. Did you even read it?

    They just are not alike in ANY respect. So why would anyone get so upset about HMFC ?
    They are alike in the specific way I cited them as being alike, in that many, many creditors are not receiving their dues and that this, therefore, warrants the term “disgrace” – CVA or no CVA.

    Mad Vlad stiffed himself with his crazy spending. Unlike Murray – who never lost a penny of HIS money.
    I’m not sure the reasoning on which you draw distinction between the two, they both seem pretty culpable to me. Either way, it does nothing to diminish my argument that both scenarios – the manner creditors have forcibly lost out – are worthy of moral outrage. I merely hope it is not lost behind the back-slapping of a successful CVA, that, I wouldn’t want to be misconstrued, I think Hearts fans have made admirable efforts to bring about.

    May be it bit harsh but get the feeling from Jim McColl’s comments and body language that he is like one of those passing acquaintances offering help to someone who is terminally ill. ‘If I can do anything just give me a call’ but the reaility is very little can be done and we all know that other than a phone call or two you won’t see him when the going gets really tough.

    RTC grew an expectation that Rangers would be found guilty of cheating the tax payer and Scottish Football.

    The FTT reached a decision that provided relief from that charge, possibly temporary, but I suggest it was the FTT decision that created the poison because it gave Rangers fans something to be angry about i.e of being falsely accused and proved innocent.

    I’m afraid innocence is the last attribute that can be applied to this situation and until such times as guilt is faced and admitted the chances of any kind of reconciliation are zilch.

    Regarding RTC expectation: The FTT became the biggest ‘grey’ provisional answer of the lot. It’s useful to remember and as you say yourself, there was an expectation level that grew on RTC, even if not always shared by RTC himself.

    As far as ‘reconciliation’ goes, this could be a major problem going forward.
    Everything is very raw, firstly you need the soap opera to come to an end and get a responsible board in place. Without ‘relative peace’ the conflict threatens the commercial which I see as the main hope that action is taken to change attitudes.

    As Paul Murray said last night if more money can be raised from any guilty parties then hopefully the creditors can get some money back.

  10. Just listened to the meeting last night. JMcC gave his reasons for not investing in the NewCo, which on the surface of it seemed to be valid i.e. he had many investors who needed to see a return on ivestments that were in a stable company ( or words to that effect) However surprised that none of the contributers asked why he on a personal basis was not investing some of his own wealth (believed to be many hundreds of millions we are led to understand by the usual press corp.) in the NewCo or buying shares. He has obviously attained his wealth using other peoples money, where have we heard that one before !!

    Yes, the “club” bears some of that responsibility indirectly, as the directors were custodians/representatives of the club, but the guilt departed the club when the individuals ceased to represent the club. Again, nothing else seems rational.

    The actions of directors are the actions of the company. I am not averse to referring offences to the Procurator Fiscal myself, but I do not (usually) refer individuals. The company is the offender. When a case comes to court, the director wot actually dun it will be called as a witness, having likely been interviewed under caution.

    The company is the “person” which takes responsibility for an offence committed in their name. Certainly there may be further charges against individuals on top of that, though.

    In short, the myth that the company (club) was not responsible is another which needs to be dropped rather than repeated.

    It may be sad that, should laws be found to be broken and a company’s trophy record adjusted accordingly, some players lose their right to medals through no personal fault of their own. However, if the company was operating outwith the laws and rules which granted it access to the competition in the first place, then how can it possibly be otherwise?

    What, for example, would happen if it were found that a team in a Cup Final had played with 12 players for the entire second half and won the game? Should the trophy be removed, or should the record stand and those 12 guys get to keep their medals because no-one noticed and they won “fairly” at the time? (Sandy Bryson may be able to help with that.)

    If I’d have raged constantly from the moment this all started I’d have spontaneously combusted a fair while ago. I prefer to think more and do the little I can in an attempt to help oust the spivs.


  14. The requisitioners actually used a rather clever (if obvious) technique to avoid answering awkward questions.

    For the most part they took 3 questions at a time, there’s no real logic to that other than to allow them to answer what they choose and leave other things to one side. That works particularly well if there is no right to reply. Which would be difficult bordering on the impossible given the 3 questions at a time method used.

    One person asked a perfectly reasonable, and pertinenet, question in a pretty simple manner. What are the plans for moving the club forward and providing finance if you win (I paraphrase). That was added in with another two questions. They didn’t even gloss over the important one, they just ignored it (or as near as makes no difference) and answered what suited them.

    Overall I think it was if anything a counter productive exercise. They provided nothing new of any substance, fobbed off those things which didn’t suit them and behaved in a thoroughly unpleasant manner. Though to be fair the last part may have endeared them to some of the loyal.

    This is a side letter guaranteeing to pay you a further £10,000 a week tax free ,NIC’s free, this has to be a secret, because we are supposed to notify the SFA of all payment’s but if we make it part of your contract it becomes taxable, we put it through the books as a loan, but you never need repay it,

    where those players paid like that before they came to Ibrox or after they left,

    2/ How will Chicky boy attempt to cover the Hearts story tomorrow? Liberal sprinklings of just like Rangers, emerging valiant from the prophets of doom, just like Rangers and that we must all ensure that this never happens again and our noble institutions, some with 141 years history ya de ya ya ya.

    If you were to look at the RTC blog, you would see that the vast majority of posters were quite happy to see new Rangers start in what was then division one. That view was maintained right up until the march on Hampden, that really was a game changer…

    I would appreciate it if sf / anyone can confirm if my memory is going. 🙂

    I thought the RTC blog was basically waiting for the insolvency event which was generally expected in Jan / Feb last year.

    However, in January [?] last year, RTC tweeted Regan to query about side-letters and the possibility that a significant number of RFC players had been incorrectly registered with both the SFA & SPL for several years. Regan gave a bland response, and shortly thereafter he dropped off Twitter.

    For me, this new info was the game changer.
    Any sympathy I had for the Govan club, and my hope that it could restart in a league with a new ethos, new history etc, totally went out of the window.

    At that point in January last year, I believed that if the RTC claims proved to be correct, then the club should be punted out of all Scottish football, period.

    I’m a manager. I need players.

    So does the manager of my rival club.

    30 players are currently available on the open market

    These 30 players are graded by quality.

    Player no.1 is much better than player no.10,

    is far, far better than player no.20. and

    makes player no.30 look like a carthorse.

    Both managers make matching offers for the top ten players.

    However, in negotiations with the players,

    manager A tells each player that his club will pay them tax free

    which means that they will get £250,000 a year more than

    they would with the rival club B.

    All of the top ten players sign for manager A.

    Manager B is unable to match the offers of club A

    because club B don’t have an illegal scheme in place for evading tax.

    Manager B then tries to sign the next ten best

    I watched that several weeks ago. Quite an insight.

    My immediate impression was that this man is NOT going to invest his own or other people’s money in Ibrox any time soon. If he does, it’ll only be if he gets it at a bargain-basement price, re-jigs it into a self-sustaining entity (bye, bye Ally and the current highly-paid players), then passes it on to someone who either *’loves the institution’ or who has more money than sense; McColl achieves his goal, with a modest profit for his investors.

    I do not think he will hang around to listen to fans demanding Walter Smith endorsed irrational spending. It’s not his style. That’s is loss-making. Shine up the failing business, sell it on. It’s what he does.

    *I’m not sure people love the club enough, simply because it has so many traits that are ‘unloveable’. The most fanatical supporters seem to be more engrossed in the ideals they’ve attached to the football club rather than the club itself. Most other football clubs don’t have this kind of baggage.

    Watched the video, it is very interesting obviously a very self driven, confident individual who has been very astute in his business dealings.
    DPs comments are proboby correct = he will not invest any of HIS money repeat HIS money, in Rangers (Newco/Oldco or whatever the legal entity is) I can understand him not investing thru his equity company. BUT WHY DOES HE NOT INVEST ANY OF HIS OWN MONEY IN THE CLUB, I think we all would like to know the answer to that one !
    The fact that he has’nt ,is’nt, probably tells us his Rangers credentials are not as great as he would have us believe.

    I think that if he invested in the club he’d want to do so in a way that afforded him a degree of control. If he had control I think he is the type who would want to be hands-on, which would occupy time he can’t afford given his shared goals with investment partners.

    He is very precise regarding goals and only once he has reached those, do I think there would be a possibility of significant investment from McColl.

    I also think football is a sector which he may see as unfamiliar and unpredictable ground where his tried and trusted methods wouldn’t necessarily be successful.

The manifestly and demonstrable counter factual claim to be the same club, whipped up in the media, is now joined by the cranking up of the ‘the club are victims’ narrative. This rests entirely on a reading of history where anything before Whyte is brushed off and ignored. The faithful lamb munchers have remained extraordinarily loyal to the ancient-regime, and for the last two years and, in the main, have simply blanked any reference to cheating of the Murray years, the FTT result and LNS results of course vindicating this stance……unless of course you bothered to read them, in which case the reputation of Rangers Football Club Ltd (IL) was torn up for sh*tey paper in a disgraceful display of fiscal malpractice and rule breaking. Whyte was guilty of crimes, there is no question of that, but the job of the bampots over the next while is to ensure Murray (all of them!) remain under scrutiny for their part in the scandalous chain of events that eventully led to the sale of a ‘global brand’ with a turnover dwarfing all but one of its competitors, was sold for a single pound to the shark infested waters of insolvency practitioners. The Knights and their media lapdogs are now positioning their tanks on the lawns of the spivs……and crucially must now convince the angry bears and the rest of us that what happend under Whyte was a never to be repeated aberration, caused by a bad man devoid of Rangersness, and now the precious club with 140+ years of unbroken history (including the Orwellian assertion that we can’t count the Whyte years where the club was duped) should be returned to trustworthy custodians with limitless reserves of dignity, probity, and Struthian honour ….the essence of Rangersness, you know folk like Dave King……….     The reputation of RFC is now tainted in perpetuity, as they are gone, they may at one time have been the people…..right now they are a circus……am I obsessed? well I have to admit an unhealthy fascination for the events down Govan way, but it is so hard to stop, it really is a wonderful show, to disengage now would be tantamount to turning your back on a firework display, why would you? 😉

    I think you are correct in your assessment . To see every thing in life thru a balance sheet must make life very dull. Surely he must have some outside interests away from business (maybe not) which he spends is well earned money on. I know if my club was in dire straits and required investment and I had available personal funds which I could help with my love for my club would over rule my business head. Indeed many of the Rangers supporters did just that last year investing in the club with hard earned cash they could ill afford especially just before Christmas
    Something about JMcC and his body language last night gives the impression that he is not fully committed to this group and their aims.

    (1) Jim McColl stating Ally would need money for strengthening the squad next summer for players to compete in the SPL – needs a year to bed them in apparently. Ignored the questions about the current players and coaching staff all being overpaid. The lack of scouting was glossed over other than the landlord of Louden Tavern (disclosed on Twitter) cracking a joke at their former rivals.

    (8) Charles Green going to the door of someone in London – seriously? So there is no phone line from his chateau yet?

    TRFC then took advantage of Hearts trouble by negotiating a deal to pay off part of what they owed Hearts for Wallace and Templeton – could have been worse if they had got Stevenson to go as well.

    I for one now have a much clearer insight into the thinking of what passes around here for the intelligent and reasonable Rangers fans.

    They love their club, but only (it appears to me) if it can be retained in some form that assures them the kind of regular feast of ‘success’ that they have grown accustomed to over years of mismanagement and cheating by successive company boards.

    Supremacists will demand supremacy after all.

    There is a state of complete denial about the validity (lack there of) of substantial parts of their historical success, that they are also desperate to maintain is unbroken despite the overwhelming evidence to the contrary.

    Their arguments and rationale are so divergent from my own and from the large part of what is expressed by supporters of other teams here on TSFM, that I find myself wondering if there is anything left to say to each other?

    We clearly have different conceptions of what constitutes acceptable business practise.

    We clearly have different conceptions of what is acceptable conduct in a sporting environment.

    We clearly have different conceptions of some fairly basic social norms.

    I have no desire to have any further association with their organisation.

    The idea that there is a poisonous atmosphere because RTC exposed their club’s shameful cheating and failure to pay taxes is kind of the last straw for me with these guys.

    It would be all too easy to come up with a string of analogies that shows the moral bankruptcy of their argument, but to be honest? I don’t have to. It really is that obvious.

    From where I stand Paul Murray has been found inadequate to represent shareholders, and patently failed to properly represent shareholders when he had the opportunity . He didn’t stand up to David Murray, and did nothing over hidden dual contracts. He claims to have challenged Murray over the sale to Whyte. Not much credit there , given Murray had been rendered impotent by Lloyds, and merely points to his lack of morale fibre when Murray had control.

    Picture the scene, Rangers and Celtic both get knocked out of the Cup this weekend.
    It would be a real blow for both and they’d be struggling to give away tickets for home games with their leagues already won. Rangers could market games around the 100% record but as soon as they drop points then that’s it all done.

    On the other hand it would open up the Scottish Cup for other teams.
    In their financial state, Hearts could do with a decent Cup run !

    What it would do is force the media to rethink their normal practise.

    Firstly, can you please list said contracts to give us an idea of the scale of “contract after contract”

    Secondly, SDM ruled in autocratic fashion until he stepped down from the chairman’s role in August 2009. Then it was Lloyds/Muir/McGill (MIH) who held sway alongside the SDM stakeholding and they would have been as receptive as SDM himself to the proposals you moot.

    Thirdly, who is to say someone on the board didn’t broach the issue of a competitive bidding process ?

    Fourthly, alongside the IBC, who presented their concerns in a report about the CW takeover he did oppose the takeover. Again the Murray/Lloyds control trumped the warning and late bid.

    Looking forward, if the requisitioners were to gain control of the boardroom the situation would be very different from his spell at the club in terms of calling the shots. Always bearing in mind that shares are traded daily and that could change.

    That is why I would wish it were realistically possible for Celtic to refuse to acknowledge the new club by refusing to play such a mockery of a game.

    A strong individual who believed in the stance Paul Murray is now advocating would not stay in position when the conflicts are so obvious. He stayed , that says a lot about his priorities in my view

    Murray says a lot that contradicts his actions , or did he not believe that Directors should not benefit from supplier contracts when he was a Director previously. He can reasonably be accused of hypocrisy and lack of
    robust action to protect the minority shareholders.

    I just left a very good job in the summer because I had an ego maniac for a boss who arrived in Feb and did not care about your opinions but wanted it done her way. However since we were doing a service to a client, she was agreeing with the client items and forgetting to tell us minions, with the effect that we were constantly embarrassed when the client found out we had no clue. Of course she told the client she had informed us and we were idiots.

    I had 2 choices – continue to be left hanging out to dry in front of the client while banking my considerable pay – or resign and find a new job rather than put your name to such a mess.

    I chose the 2nd option – but it worked out ok as I have a new job now and am doing well – however the project I was on is now an utter catastrophe that only the ones that were not fired or left are holding the can. And the dictator continues to do it her way!

    Paul Murray (as did Malcolm, Ally and Walter) had a choice when confronted with people who would not let you do your job or listen to your opinions- leave with dignity or go with the program and be tarred with the same brush.

    Sometimes it takes courage – but the ability to look at yourself in the mirror for doing the right thing is priceless – that is dignity!!

    The whole email is interesting on the Return of capital issue. In particular the following points:

    7. R P Bernstein on 18 October 2012: £400,000
    8. Laxey Partners on 19 October 2012: £1,000,000
    9. Mr Olverman stated to Ms Crompton that no refund was made to Laxey Partners, and that their investment is shown at £1m on the share register.

    The question which looms here is what constitutes a ‘refund’. There might not have been any cash paid to Laxey Partners like there was to Eurovestec and R P Bernstein. But there was the transfer of personal shares of Charles Green to Laxeys which made-up the difference in the £1 price per share paid compared to the 70p flotation figure. So in essence they all endedup the same but it might be that Deloitte didn’t suss that Laxeys had also been reimbursed.

    And as I have questioned many times – why was Green giving them his personal shares to pay them a refund when the company was paying cash direct to other overcharged investors.

    As to the Mackenzie out in Australia I don’t know if he ever got a refund or was just ignored because he wasn’t based in ‘The City’ and therefore was of no real threat to Rangers spivs.

    The AIM announcement on 5 June 2013 by RIFC Plc stated:

    The Company announces that under an agreement entered into by Charles Green, the former CEO of the Company, with Laxey Partners Ltd (“Laxey”) on 19 October 2012, Mr Green has agreed to transfer 714,285 shares owned by him to Laxey, once free to effect a transfer. Under the terms of the lock-in agreement entered into by Mr Green with the Company on 7 December 2012, Mr Green is prevented from transferring shares before 7 December 2013, without the consent of Cenkos Securities plc other than in limited circumstances such as to connected persons, a family trust or in the event of a takeover of the Company.

    The interesting thing about the AIM agreement is that it isn’t clear whether Green agreed on 19 October 2012 to transfer 714,285 shares owned by him to Laxey which is the same date mentioned in the email from the Deloitte director that £1 million was recorded in the Main Cash Book of RIFC Plc in respect of the gross initial receipts for the subscription of shares by Laxey Partners.

    Now would Deloitte regard that as a return of capital? Looks like it to me but is it within or outwith the rules? That is the question 😆

    It means he wouldn’t get out of bed for the sort of money being quoted in the press and has taken it as a personal insult. Hence the suggestion that it is “wildly inaccurate” meaning he’s on a big Cayman Island Bonus far in excess of the chicken feed quoted.

    Either that or he is being clever with words by suggesting that he believes that kind of fee is beyond the dreams of avarice and that is of course the meaning many will take from it. It is however a slime covered statement from those who are paid to mislead us whether in sport or politics.

    I think you are correct in your assessment . To see every thing in life thru a balance sheet must make life very dull. Surely he must have some outside interests away from business (maybe not) which he spends is well earned money on. I know if my club was in dire straits and required investment and I had available personal funds which I could help with my love for my club would over rule my business head. Indeed many of the Rangers supporters did just that last year investing in the club with hard earned cash they could ill afford especially just before Christmas
    Something about JMcC and his body language last night gives the impression that he is not fully committed to this group and their aims.

    Good point. The fact that when his team needed saving at the IPO time all he did was put in a nominal amount, nor was he there when he could have bought the club for £5.5M. It seems he knew to keep clear for a bit until the mess was cleared up a bit or King had some free cash.
