Fair Play at FIFA?

The following post comes about as a result of the research and work put in by Auldheid.

He has drafted the submission to FIFA detailed below after closely looking at their rules, and taking on board the points contained in the Glasnost “Golden Rule” blog. TSFM has attached the blog’s name to the report since the overwhelming – but not unanimous – view of our readership is that the SFA and the SPL have again gotten themselves into an almighty and embarrassingly amateur fankle over this issue.

We believe that tens of thousands of football fans will be lost to the game if the outcome of the LNS enquiry is not perceived to be commensurate with the scope and extent of the rule breaking that LNS found had taken place. In view of this, we believe that we have to do what we can to explore all possibilities for justice for those who love the game so much and yet are utterly disillusioned by recent events.

LNS is not being questioned here. He has found that RFC were guilty as charged by the SPL.

What is being questioned is the SFA’s crucial – and seemingly conflicted  – role in the LNS enquiry, as is the effectiveness of LNS’s recommended sanction as either a deterrent or an upholder of sporting integrity.

It came to our notice last week that FIFA have created a web site at

that tells us that FIFA have implemented a regulatory framework which is intended to ensure that all statutory rules, rules of conduct and internal guidelines of FIFA are respected and complied with.

In support of that regulatory framework FIFA have set up the above site as a reporting mechanism by means of which inappropriate behaviour and infringements of the pertinent regulations may be reported.

FIFA say that their jurisdiction encompasses misconduct that (1) relates to match manipulation; (2) occurs in or affects more than one confederation, so that it cannot adequately be addressed by a single confederation; or (3) would ordinarily be addressed by a confederation or association, but, under the particular facts at issue, has not been or is unlikely to be dealt with appropriately at that level.

Discussions arising from the previous blog on TSFM, “Gilt Edged Justice”, which was published after Lord Nimmo Smith (LNS) ruled on the registration of Rangers players who had contractual side letters that were not disclosed to the SFA as part of their registration, suggest that there may be possible unfortunate consequences for football arising from the evidence presented by the SFA to the LNS enquiry that informed its findings on registration and consequent eligibility. There is also a question of the propriety of the SFA providing evidence on an issue which could have had a negative impact on them had it been found that they had failed to carrying out their registration duties with due rigour over a period of ten years when the existence of EBTs was known to officials within the SFA.

On the basis that the LNS findings require that registration rules be clarified by FIFA and rewritten globally if necessary to remove any ambiguity and under clause 3 above, this appears to be an issue that the FIFA should examine and that the SFA cannot address.

The following report has therefore been submitted by TSFM on behalf of its readers to FIFA drawing on the content and debate following the “Gilt Edged Justice” blog in respect of the possible footballing consequences of the LNS enquiry.

The hope is that by speaking for so many supporters, FIFA will give the TSFM submission some weight, but individuals are free of course to make their own points in their own way.  We await acknowledgement of the submission.

The report Submitted to FIFA is as follows;

It is our belief that FIFA general rules of conduct were breached by the SFA and their employees in both creating and then advising The Lord Nimmo Smith (LNS) enquiry into the non disclosure of full payment information to the Scottish Football Association (SFA) by Rangers F.C during a period of player registration over 10 years from 2000.

We believe that although the issue has been addressed by the SFA the particular facts at issue suggest that it has not been dealt with appropriately and we therefore ask FIFA to investigate. The facts at issue are that the process and advice given failed to uphold sporting integrity, and that a conflict of interest was at play.

We believe the advice provided and the enquiry set up, where SFA both advised and is the appellant body, breaches not only the integrity the registration rules were intended to uphold, but also totally undermines the integrity of the SFA in breach of General Conduct rules 1, 2 and 4. (See below.)

1.  Firstly we believe that the advice supplied to LNS that an incorrectly registered player was eligible to play as long as the registration was accepted by the SFA however unwittingly, undermines the intent of the SPL/SFA rules on player registration and so undermines the integrity of football in three ways.

• It incentivises clubs to apply for a player to be registered even if they know that the conditions of registration are not satisfied, in the hope that the application will somehow ‘slip through the net’ and be granted anyway (in which case it will be valid until revoked).

• A club which discovers that it has made an error in its application is incentivized to say nothing and to ‘let sleeping dogs lie’ – because it would be in a better position by not confessing its mistake.

• And most importantly, it incentivises fraud.  By deliberately concealing relevant information, a club can ensure that a player who does not satisfy the registration conditions is treated as being eligible – and therefore allowed to play – for as long as a period as possible (potentially his entire spell with the club). Then, if the club is no longer around when the deception is finally discovered, imposing meaningful sanctions may be impossible.

2.   Secondly we believe the process followed was inappropriate due to a Conflict of Interest. Had the LNS enquiry not ruled on the basis of advice supplied by The SFA, they and those persons advising the LNS enquiry, could have been subjected to censure and the SFA to potential compensation claims had LNS found that the players were indeed ineligible to play and results then been annulled as was SFA practice when an ineligible player played.

3.  Finally we contend that a law should not be applied according to its literal meaning if to do so would lead to an absurdity or a manifest injustice or in this case loss of football integrity.

4. We therefore ask FIFA to investigate both the process used and advice given to Lord Nimmo Smith to satisfy themselves that FIFA’s intentions with regard to upholding the integrity of football under FIFA rules have not been seriously damaged by the LNS findings and also to reassure Scottish football supporters that the integrity of our game has not been sacrificed by the very authority in whose care it has been placed to promote the short term cause of commercialism to the games long term detriment.

1. Persons bound by this Code are expected to be aware of the importance of their duties and concomitant obligations and responsibilities.

2. Persons bound by this Code are obliged to respect all applicable laws and regulations as well as FIFA’s regulatory framework to the extent applicable to them.

4. Persons bound by this Code may not abuse their position in any way, especially to take advantage of their position for private aims or gains.

    As far as I can see, Jackson has basically cribbed all his info from here (Hi Keith!), much like he did when he was forced to retract his story about ticketu…..er…. sorry, I mean, broke the story about Craig Whyte’s dodgy deals.

    I don’t think it’s that he’s suddenly developed a conscience about what’s going on, or that he’s scared that he’ll look a bit stupid in the coming months (he’s the ‘wealth off the radar!’ man, after all….). I think it’s just more likely that , as Big Pink said, there’s a new horse to back.

    I wouldn’t be surprised to see some or all of the Blue Knights (or associates of them) suddenly come out the woodwork in the coming months. Let me be clear, I don’t actually have any secret info that’s lead me to this conclusion – I only base it on what happened last time the DR suddenly turned on the owner of the club playing out of Ibrox, having peddled his nonsense previously without question.

    After a very studied consideration of the Structure, Articles of Association, Rules and Shareholders Agreement, the Board of St Mirren Football Club have decided that they will be unable to support the motion at next Monday’s Meeting of SPL Clubs regarding this proposal for League Reconstruction.
    This view has been taken after careful thought regarding this proposal including engagement with fans and the views of our coaching staff.

    The principles of a new league structure, single league body and all through distribution model are part of many aspects of this we fully support, however the proposal as presented does not, in our view, move the game forward.

    The concept of playing 22 games prior to breaking into three leagues of eight, including the middle eight losing their points gained in the first series of games, is not a system we see as taking the game forward in the long term. You will be aware that other countries have tried this system and have since rejected such a set up.
    We also feel that this system is not fair to fans who buy into their club by way of a season ticket, who are then unsure of what they are purchasing. It is also against the basic wishes of the fans for larger leagues as highlighted in all recent fan surveys.

    In the proposed rules the voting structure is remaining, in all items that are of importance, an 11-1 vote. In our opinion, this is fundamentally wrong in any structure and is the principle reason why Scottish League Football has not been able to restructure prior to this time, a view St Mirren have held for some time.
    The restriction on any change for three years is also very much against our view. When engaging with any new rule book there will always be oversight and anomalies that need to be revised on an annual basis.

    An area St Mirren are very uncomfortable with is the lock down on various financial rules. The credibility of Scottish Football has been tarnished badly in recent times by financial mismanagement and the time has come for strong financial rules to be in place.

    Another concern to us is the hard line taken by some in certain areas, like season start date, home-grown talent, under-21 rules. This is not an exhaustive list, however we do think these items require negotiation for the betterment of Scottish Football in general.

    We also do not accept that this is a take it or leave it situation. We do wish to keep working towards one organisation, an all through distribution model and getting closer to our supporters’ wishes of a larger league, while being fully aware of the commercial and financial pressures of operating a football club.

    If there is a distinct possibility that the spivs are likely to leave the stage with much of the £22M raised from the IPO – or that much of this has been burned allready – a consortia heading up RFC Mark III are going to have to raise capital in the future – unless those who may come forward to rescue (again) football at Ibrox have very deep pockets.

    What market would let a varient of RFC mark III into their exchange?

    Who would take on the sponsorship of an IPO?

    Will the fans shell out more money for shares – for a third time?

    If there is mileage in the TEGF / CG pack to purchase the assets of RFC from Duff and Duffer (copyright acknowledged) and the sale of the assets is found to be illegal – then it is highly unlikely that any consortia running footballing activities from Ibrox will have access to any financial markets. – (Am I being overly optimistic here?)

    There is a great line in the film “The right stuff” – “No bucks, no Buck Rodgers.”

    Without access to the financial markets – how can RFC raise funds to put a decent team (no laughing at the back) on the park?

    Can a company survive pi$$ing off the markets big time?

    I don’t care where he got it, fact is he is sharing it with the masses. I cannot see a downside to that. As much as we would like to think that we are shaping opinion here, we are only doing that to a limited audience, we need some support to widen that reach, SC and AT helped with that and this article serves the same purpose.

    I agree that the bulk of the authorities have moved to help keep the Club alive – however, HMRC to my mind have been consistent in chasing down what they believe to be wrong.

    It looks as if HMRC have held a steady, independent line:

    They attempted to block Duff and Duffer (copyright acknowledged) as administrators;

    By all accounts HMRC told the First Minister to take a hike and mind his own business when they were approached to lend a hand; and

    As we all now, they have decided to appeal the FTTT.

    HMRC have much to loose if they let the spivs walk away untouhed – they need to retain their teeth. For that reason I cannot see them lying down to (S)DM, TEGF and CG.

    In all of this HMRC have been pretty much consistent in their approach – silently working to get the result they believe is right.

    It’s like there has been a total eclipse on what the paper’s actually said at the time.
    I agree that a lot of what he say’s is correct and accurate but for me it’s too little too late, and it read’s like sour grapes.
    It’s like trying to score points off of another’s mistakes. Maybe if this was the type of reporting they had printed all along then the paper (and many other’s) would not be in the position they find themselves in now.

    In contrast to some of the comments here praising Jangles for finally getting his act together however belatedly, in my opinion this article represents an even greater indictment of his succulent lamb MO.

    It shows that, despite all the “we are jist simple fitba men who’ve been duped” line that has been put to the fans all this time, his paper is indeed capable of pulling at least some threads together to illuminate the big picture but have simply chosen not to do so.

    The fact that he chooses to do so now, in some fit of pique at a rival scoop, or on behalf of some dignified figure ready to swoop from wings, or a combination of both, makes the previous dereliction of duty all the more scandalous.

    Whatever the merit of this article, Jangles remains a shameless pro-Rangers Lord Haw Haw figure

    Yes it’s important that we always remember that the whole reporting of this incestuous debacle from the word go was handled by basically brain-dead football journalists. The management of virtually every Scottish media organisation made what appears to be a collective decision not to get their business or investigative reporters involved.

    So it was highly unlikely that sports journos would be able to find a real exclusive and even if they had then the complexities of it would have been beyond them and we must never ever forget their succulent lamb staple diet which eventually emerged as PR stodge – it’s alimentary I’m afraid.

    Worth remembering that one of the conditions of AIM membership is that the company concerned must run a website to provide news to shareholders. That could be an Achilles’ Heel for Rangers International as the info has to obviously accurate.

    rangers , uniquely, have no access to conventional bank borrowings or even an overdraft facility.

    That should have raised a red flag with the so called “financial advisors” amongst the rangers blogging community

    No business voluntarily denies themselves of these facilities. Should they be denied access to financial markets for fundraising, and like you I believe 2 strikes and you are out, whilst running a business burning approximately 10% of their cash reserves each month , then the future is very bleak indeed

    In my view Green is a dead man walking as CEO, Macolm Murray and other directors will very quickly be in the same position if they continue to act like the 3 wise monkeys

    The only way forward, is for Green to be fired, McColl and Park to enter stage right,with an offer to all Zeus related shareholders of 10 p per share, for them to guarantee bank facilities for a 3 year period and for everone connected to Zeus to be emptied from a position of influence

    It won’t happen of course, at least not voluntarily, and the Rangers fans will be against it . Not least because it has been suggested by ‘Timmy”

    Greed, and desperation will ensure Green and Zeus hang on until fate and lack of cash force their hand


  29. I personally am not convinced that the rejecting of the reconstruction proposal by St M and Ross County makes an SPL2 less likely. This assumption does however require that the Chairmen do take the view that it’s their team first, naturally, but that a sustainable football environment is required for them to operate in. Consider that they’re all in plane. The captain comes over the tannoy to say right guys we’ve run out of fuel, who votes that we land? Surely they wouldn’t all abstain?

    I am also of the belief that the 11-1 voting structure remains to avoid proposals such as an invitation SPL2 going through without virtually unanimous support, not to assist them. Was it not Stewart Milne who, at the original licence transfer vote said something like I didn’t like what was on the table and I didn’t much fancy their plan B, or words to that effect.

    What I don’t get is why, with support for a radical restructure being doubted (and that’s putting it mildly) last September are we now at April without anyone knowing what’s even coming in August.

    Farcical.

    That is the first time I have seen the 11-1 mentioned, and the first time I realised it was staying. Therefore – the proposal has to fail. Until a fair voting system is introduced Scottish Football will continue to flounder. If there is to be one body, rule changes should happen with a simple majority of ALL league clubs.

    Therefore, whether there is a TRFC influence or not, this league proposal needs to fail.

    An SPL2 with TRFC invited should not be allowed to happen by the fans (in the same way we made sure TRFC started in the bottom league) – the clubs won’t have a chose.

    And as BP doesnt seem to be online I’ll stick my neck out and say criticism (or approval!) of Thatchers politics is well off topic – plenty else happening in Scottish football (and Ibrox) right now!

    Steven, she was such a divisive figure that it was inevitable that comments would be passed here and on many other blogs. It’ll pass. Thatcher was the figurehead of a movement that led to the business practices of Murray and Masterson and made life easier for the spivs. A bit of stick for her politics won’t do any harm.

    In any case, why would this perceived (but non-existent) dislike of Celtic water down any points I might like to make? Are Celtic supporters unwilling to accept an outsider criticising Celtic? Does this outsider status automatically dilute what they say?

    It seems to me that we often wonder why Rangers fans don’t listen to the “facts” about their club. Perhaps they are of a similar mindset – beleiving that comments coming from people who obviously dislike their club are simply watered down.

    Agreed. It would be silly to ignore Thatcher’s passing, so I understand if people make reference to the news and we are happy to allow that. However although I am quite definitely not a friend of the woman, I think the tone of this blog should inform the rest of us how to behave in response to these kinds of situations.

    Few people in this country will mourn her passing, but expressions of delight or grief are way beyond the acceptable line on here.

    I’m a Celtic fan and I agree that a lot of Celtic fans are unable to accept criticism of our club and/or the support.

    I’ve left replies on various websites or bloggers pages being critical of their written piece or stance, including The Celtic Journal, CQN and Phil Mac Giolla Bhain.

    Many times I’ve had the replies not pass moderation for no other reason than they’re critical of their article or their opinion and my reply doesn’t fit their agenda. Phil MAc Giolla Bhain being the worst culprit. I just stopped reading his blogs, unfollowed on Twitter and unfriended on Facebook.

    If you’re not prepared to accept constructive criticism then you shouldn’t be blogging.

  51. Re the rants by Charles Green of a racist nature, on a personal basis I wonder what the Rangers fans who accused me of racially abusing one of their players last year are doing about their CEO. What they put me thru just because I had a name the same as an individual, who was in police custody within hours of the offence, was indeed frightening especially for an OAP. The telephone calls, threats, name address and telephone number on social networking site etc, “comments of “coming to get you” etc, I eventually had to get the police involved. The man who praises his support soo highly then comes out with this rubbish whether he thinks it is of a friendly mature or not, should not be in a position at one of the former great clubs in our land.

    I truly believe that is a question for the Rangers support because they, at the end of the day, are the ones that need to decide what kind of club they want. What outsiders think will do nothing to change their collective mind – of that I am convinced.

    Charles Green should not be allowed near any Scottish club…his behaviour towards various clubs and individuals within Scottish Football has been at best appalling…as for Ally…not really bothered who manages the new club…although I feel his conduct over the last 12 months has been questionable at times


  57. Interesting angle mentioned by others re: the Chairman, other Directors & Non-Execs – and their apparent lack of activity in the last few days.

    As the experienced Chairman, one would at least expect Murray to issue a statement to try and defuse or soothe the situation. That should have been done before now – and Green should have been told to keep his head down for the duration.

    The fact that Charlie is allowed to continue to dig a hole for himself doesn’t reflect at all well on his fellow Board members.

    For a ‘normal’ plc, someone would have to walk in this situation.

    But I can’t help thinking that Charlie’s buffoonery is part of his strategy – to be ‘invited’ to resign ?

    I dont think CG is interested in anything other than the money he and his investors will make. At present if they can get out in the next few months there might be enough cash in the bank left for new owners to make a fist of it on the field of play.

    TRFC should be using the time in the lower divisions to reduce costs & reach break even whilst investing just enough to win promotion. QOTS won Div 2 with a squad budget of £300k apparently. Cant imagine Partick or Morton’s budget is much bigger.

    Doing similar would give them a decent cash pile to invest in SPL standard players once they reach top division & in time bring further quality as cash & success permits. It is at least a 5 year plan if not closer 7-10 years.

    Why they are not doing so leads me to suspect the SFA/SPL promised a leg up & this dovetailed nicely with CG’s get rich quick scheme.

    Forget about the players, the salaries being paid to AMcC, CG & BS are obscene. Even if TRFC were making a profit, they would only be classed as medium sized business with £25/30m in turnover. By way of comparison the Wood Group turnover in 2011 was in excess of £6billion. 5 of the 6 directors received less than CG in basic salary and all at least £100k less than Ally.

    In my view just about anybody could do better if the goal was to make TRFC a success.

    But its not.

  66. I´ve heard it mentioned on here that if CG were to get sacked as CEO then his 12 month lock-in period on his shares would suddenly end.

    Please can someone who has the relevant expertise or has done the research tell me if this is true ?

    If it were accompanied by a link with a list of causes for the lock-in period to be discontinued all the better.

    I seem to remember a possible 6 month extension to this 12 months which was easier to get around with said conditions printed in the prospectus.
