Fair Play at FIFA?

The following post comes about as a result of the research and work put in by Auldheid.

He has drafted the submission to FIFA detailed below after closely looking at their rules, and taking on board the points contained in the Glasnost “Golden Rule” blog. TSFM has attached the blog’s name to the report since the overwhelming – but not unanimous – view of our readership is that the SFA and the SPL have again gotten themselves into an almighty and embarrassingly amateur fankle over this issue.

We believe that tens of thousands of football fans will be lost to the game if the outcome of the LNS enquiry is not perceived to be commensurate with the scope and extent of the rule breaking that LNS found had taken place. In view of this, we believe that we have to do what we can to explore all possibilities for justice for those who love the game so much and yet are utterly disillusioned by recent events.

LNS is not being questioned here. He has found that RFC were guilty as charged by the SPL.

What is being questioned is the SFA’s crucial – and seemingly conflicted  – role in the LNS enquiry, as is the effectiveness of LNS’s recommended sanction as either a deterrent or an upholder of sporting integrity.

It came to our notice last week that FIFA have created a web site at

that tells us that FIFA have implemented a regulatory framework which is intended to ensure that all statutory rules, rules of conduct and internal guidelines of FIFA are respected and complied with.

In support of that regulatory framework FIFA have set up the above site as a reporting mechanism by means of which inappropriate behaviour and infringements of the pertinent regulations may be reported.

FIFA say that their jurisdiction encompasses misconduct that (1) relates to match manipulation; (2) occurs in or affects more than one confederation, so that it cannot adequately be addressed by a single confederation; or (3) would ordinarily be addressed by a confederation or association, but, under the particular facts at issue, has not been or is unlikely to be dealt with appropriately at that level.

Discussions arising from the previous blog on TSFM, “Gilt Edged Justice”, which was published after Lord Nimmo Smith (LNS) ruled on the registration of Rangers players who had contractual side letters that were not disclosed to the SFA as part of their registration, suggest that there may be possible unfortunate consequences for football arising from the evidence presented by the SFA to the LNS enquiry that informed its findings on registration and consequent eligibility. There is also a question of the propriety of the SFA providing evidence on an issue which could have had a negative impact on them had it been found that they had failed to carrying out their registration duties with due rigour over a period of ten years when the existence of EBTs was known to officials within the SFA.

On the basis that the LNS findings require that registration rules be clarified by FIFA and rewritten globally if necessary to remove any ambiguity and under clause 3 above, this appears to be an issue that the FIFA should examine and that the SFA cannot address.

The following report has therefore been submitted by TSFM on behalf of its readers to FIFA drawing on the content and debate following the “Gilt Edged Justice” blog in respect of the possible footballing consequences of the LNS enquiry.

The hope is that by speaking for so many supporters, FIFA will give the TSFM submission some weight, but individuals are free of course to make their own points in their own way.  We await acknowledgement of the submission.

The report Submitted to FIFA is as follows;

It is our belief that FIFA general rules of conduct were breached by the SFA and their employees in both creating and then advising The Lord Nimmo Smith (LNS) enquiry into the non disclosure of full payment information to the Scottish Football Association (SFA) by Rangers F.C during a period of player registration over 10 years from 2000.

We believe that although the issue has been addressed by the SFA the particular facts at issue suggest that it has not been dealt with appropriately and we therefore ask FIFA to investigate. The facts at issue are that the process and advice given failed to uphold sporting integrity, and that a conflict of interest was at play.

We believe the advice provided and the enquiry set up, where SFA both advised and is the appellant body, breaches not only the integrity the registration rules were intended to uphold, but also totally undermines the integrity of the SFA in breach of General Conduct rules 1, 2 and 4. (See below.)

1.  Firstly we believe that the advice supplied to LNS that an incorrectly registered player was eligible to play as long as the registration was accepted by the SFA however unwittingly, undermines the intent of the SPL/SFA rules on player registration and so undermines the integrity of football in three ways.

• It incentivises clubs to apply for a player to be registered even if they know that the conditions of registration are not satisfied, in the hope that the application will somehow ‘slip through the net’ and be granted anyway (in which case it will be valid until revoked).

• A club which discovers that it has made an error in its application is incentivized to say nothing and to ‘let sleeping dogs lie’ – because it would be in a better position by not confessing its mistake.

• And most importantly, it incentivises fraud.  By deliberately concealing relevant information, a club can ensure that a player who does not satisfy the registration conditions is treated as being eligible – and therefore allowed to play – for as long as a period as possible (potentially his entire spell with the club). Then, if the club is no longer around when the deception is finally discovered, imposing meaningful sanctions may be impossible.

2.   Secondly we believe the process followed was inappropriate due to a Conflict of Interest. Had the LNS enquiry not ruled on the basis of advice supplied by The SFA, they and those persons advising the LNS enquiry, could have been subjected to censure and the SFA to potential compensation claims had LNS found that the players were indeed ineligible to play and results then been annulled as was SFA practice when an ineligible player played.

3.  Finally we contend that a law should not be applied according to its literal meaning if to do so would lead to an absurdity or a manifest injustice or in this case loss of football integrity.

4. We therefore ask FIFA to investigate both the process used and advice given to Lord Nimmo Smith to satisfy themselves that FIFA’s intentions with regard to upholding the integrity of football under FIFA rules have not been seriously damaged by the LNS findings and also to reassure Scottish football supporters that the integrity of our game has not been sacrificed by the very authority in whose care it has been placed to promote the short term cause of commercialism to the games long term detriment.

1. Persons bound by this Code are expected to be aware of the importance of their duties and concomitant obligations and responsibilities.

2. Persons bound by this Code are obliged to respect all applicable laws and regulations as well as FIFA’s regulatory framework to the extent applicable to them.

4. Persons bound by this Code may not abuse their position in any way, especially to take advantage of their position for private aims or gains.

  5. Talk of bailiffs and padlocks feels a bit premature. Anyone with experience of these processes able comment on what would happen in a dispute over ownership?

    Wouldn’t there need to have been at least a series of court hearings and evidence submission to even establish if there is a credible dispute over ownership?

    That’s a big conspiracy. Can’t honestly see TU being in on it. If the two Sevco’s switch story is true Mr Green seems to have become rather opportunistic when he saw that he could grab the loot. A conspiracy that turned into a free-for-all?

    Now knowing that he has lied about his past, or at least failed to disclose, they realised they had – to use snooker parlance – “a shot to nothing” i.e. A difficult long pot that would secure a hefty profit, but with the insurance that the cue ball would end up returning safely to baulk if it missed leaving nothing on for their opponent i.e. they could sue him to get their money back.

    I’m sure if these guys are good at anything, it is calculating risk.

    I would hold any breath waiting on the msm, but it does seem far fetched. It seems almost inevitable that Sevco FC plc will go under at some point if they are at the centre of a long dragged out legal battle, but they would starve to death rather than drop dead this suddenly.

    I don’t know how it would all work, but I can’t imagine that sheriff officers would be mobilised without there being some kind of court process where the bampots would have picked up on it.
    The usual story of people putting money on 13 black and if they are right saying that they knew for certain it would happen?

    Let’s be frank about it, the reconstruction proposals are a joke. About the only sense Charles Green has made has been when saying that the SFL would be mad to merge with the SPL without getting to look at its finances in detail. He might even be on to something when he suggests that the SPL could be in serious financial trouble.

    What isn’t clear is why the hurry with any reconstruction unless there is a fire burning somewhere? Is it to get Sevco into the top division asap? Is it to hide the technical insolvency of the SPL? Can sky pull the plug on the TV deal?

    Whatever the real story is no one believes that shuffling deck chairs like this is going to mean any difference to the Scottish game. We have tried all sorts of league formats and none have changed the general trajectory of the game.

  23. Having read Paul McConville’s efforts today (and I take Greenock Jacks comment above in similarly good vein re Paul) I think I’ll have a stab at the question who’s worse, Green or Whyte?

    Its actually Green. Although Whyte nearly doomed their club (copyright DJ – in the same way the man with the swanvesta nearly doomed joan of arc) at least in his deliberate beaching he had the sense (luck or judgement?) to keep the whole thing together as one parcel (the term “pre pack” provides the answer why). Green has potentially driven a wedge now between the club’s future activities – the crowds, the merchandise etc, the glorious adventure – and the assets (Murray Park and Greyskull). That wedge is a large group of investors owed 17m (notice I’m ignoring the fans contribution here, they’d better get used to that). Will they rely on future footballing greatness in div 2 for their reward (bearing in mind they won’t invest in backwater clubs like ManU or Liverpool) or will they look to the assets?

    Ah, I hear you say, but a stadium is worth nothing unless its a stadium housing football. Firstly I would argue the point but that’s by the by for now. More importantly, arguing the former point to try to insulate the club against any investor backlash is basically proving BDO’s case for them. Unless of course the investors keep schtoom because they’re not in it for the money and simultaneously require absolute anonimity – Charlotte 18 anyone – Again, that’s exactly what BDO are waiting to hear you would think.

    CG is going to need that running pedigree a la Alf Tupper methinks.

We need to do a one-time restructuring to shed all of these liabilities and return our club to stability. I am sorry I had to mislead you during the takeover but needs must when the devil drives. From now on I will be honest and direct. I will not sugarcoat the bad news. It is the result of 20 years of excess and mismanagement. That stops from today. Will you follow on?”

    They would have backed him in huge numbers. A Fergus style revival and fans would have bellied up. It is just funny that Whyte and Green have deceit so deeply in their core, they didn’t see that the real opportunity was in blunt honesty.

    Surely the MO of the switcheroo required to do “a Pheonix” – non-payment of PAYE & NI, gratuitous alienation of assets, dumping debt etc. – could not be stated openly in the public domain even if Whyte ever had the slightest intention of taking the club forward.

    Hindsight is a wonderful thing. I remain in the belief that anything less than moonbeam warchests of tens of millions of pound would not have been palatable to the bears. This is revisionist claptrap. Remember “we deserve better” and “step up and pay”?

  40. The racist comments are really quite revealing, what kind of individual could miss the campaign to fight racism in the last decade? I’ve been a regular at Scottish football grounds since the 70’s and for much of the time, overt, loud and angry racism, homophobia, sexism has been the norm, rather than the exception. I’m not saying it did not exist in other spheres of society, but it was considerably worse on the terraces. Football deserves some credit for the considerable transformation of its public space and at all levels has cleaned up its act, very much in tune with any other public spaces….racism is simply no longer acceptable conduct. Greens remarks reveal an individual who appears to have missed this particular change in attitude and behaviour…..has he never read a magazine, newspaper, or listened to a news bulletin? The comments I read were those of an individual who is utterly detached from the rest of us, whose connection with the world, outside his own workplace is pretty much zero! I imagine he cruises around in his jag listening to his Pat Boone tapes to relax, beyond that the rest of the world is pretty much irrelevant to him.

    For TRFC to try and fast-talk its way out of this latest Whyte/Green debacle, the club would have to go with the oft used defence: “We where duped!”

    IMO, the only way TRFC ‘should’ be able to retain its Associate license – and possibly avoid further sanctions – is if they publicly disown Charlie, and plead ignorance to the SFA/SFL ?

    The longer Charlie stays, the more it looks like TRFC as a club is complicit in the shady dealings of both Whyte & Green.

    I didn’t get it from the land registry, but someone else on a Hearts board did. I’m sure that Corsicacharity also posted the same a few months ago.

    What does it tell us? Basically that TRFC Ltd hold the title deeds. RIFC is a distinct entity, but now have control of what happens to TRFC Ltd’s assets, by dint of it being the TRFC Ltd’s parent company.

    There is nothing in the entry that shows when or if there was an earlier transfer between the Oldco and Sevco 5088 and onto Sevco Scotland (even the same day), or whether the transfer was directly between the Oldco and Sevco Scotland.

    SFA unlikely to ask any really probing questions which might give them answers they don’t like

    No further comments from the police though.

    If the police are investigating CW’s initial takeover and eventually this initial takeover is deemed illegal, this would then presumably remove all CW’s hold over the assets;

    Would that clear the way for SDM to return as the ‘rightful’ owner, removing all the spivs in one fell swoop?

    Police have carried out a series of raids relating to the purchase of Rangers Football Club by Craig Whyte from Sir David Murray.
    Police Scotland said they had “carried out a number of searches” in at addresses in both Scotland and England.
    The statement said: “These searches related to both domestic and business premises.
    “This remains an ongoing investigation, and no further information can be provided at this stage”.
