Fair Play at FIFA?

The following post comes about as a result of the research and work put in by Auldheid.

He has drafted the submission to FIFA detailed below after closely looking at their rules, and taking on board the points contained in the Glasnost “Golden Rule” blog. TSFM has attached the blog’s name to the report since the overwhelming – but not unanimous – view of our readership is that the SFA and the SPL have again gotten themselves into an almighty and embarrassingly amateur fankle over this issue.

We believe that tens of thousands of football fans will be lost to the game if the outcome of the LNS enquiry is not perceived to be commensurate with the scope and extent of the rule breaking that LNS found had taken place. In view of this, we believe that we have to do what we can to explore all possibilities for justice for those who love the game so much and yet are utterly disillusioned by recent events.

LNS is not being questioned here. He has found that RFC were guilty as charged by the SPL.

What is being questioned is the SFA’s crucial – and seemingly conflicted  – role in the LNS enquiry, as is the effectiveness of LNS’s recommended sanction as either a deterrent or an upholder of sporting integrity.

It came to our notice last week that FIFA have created a web site at

that tells us that FIFA have implemented a regulatory framework which is intended to ensure that all statutory rules, rules of conduct and internal guidelines of FIFA are respected and complied with.

In support of that regulatory framework FIFA have set up the above site as a reporting mechanism by means of which inappropriate behaviour and infringements of the pertinent regulations may be reported.

FIFA say that their jurisdiction encompasses misconduct that (1) relates to match manipulation; (2) occurs in or affects more than one confederation, so that it cannot adequately be addressed by a single confederation; or (3) would ordinarily be addressed by a confederation or association, but, under the particular facts at issue, has not been or is unlikely to be dealt with appropriately at that level.

Discussions arising from the previous blog on TSFM, “Gilt Edged Justice”, which was published after Lord Nimmo Smith (LNS) ruled on the registration of Rangers players who had contractual side letters that were not disclosed to the SFA as part of their registration, suggest that there may be possible unfortunate consequences for football arising from the evidence presented by the SFA to the LNS enquiry that informed its findings on registration and consequent eligibility. There is also a question of the propriety of the SFA providing evidence on an issue which could have had a negative impact on them had it been found that they had failed to carrying out their registration duties with due rigour over a period of ten years when the existence of EBTs was known to officials within the SFA.

On the basis that the LNS findings require that registration rules be clarified by FIFA and rewritten globally if necessary to remove any ambiguity and under clause 3 above, this appears to be an issue that the FIFA should examine and that the SFA cannot address.

The following report has therefore been submitted by TSFM on behalf of its readers to FIFA drawing on the content and debate following the “Gilt Edged Justice” blog in respect of the possible footballing consequences of the LNS enquiry.

The hope is that by speaking for so many supporters, FIFA will give the TSFM submission some weight, but individuals are free of course to make their own points in their own way.  We await acknowledgement of the submission.

The report Submitted to FIFA is as follows;

It is our belief that FIFA general rules of conduct were breached by the SFA and their employees in both creating and then advising The Lord Nimmo Smith (LNS) enquiry into the non disclosure of full payment information to the Scottish Football Association (SFA) by Rangers F.C during a period of player registration over 10 years from 2000.

We believe that although the issue has been addressed by the SFA the particular facts at issue suggest that it has not been dealt with appropriately and we therefore ask FIFA to investigate. The facts at issue are that the process and advice given failed to uphold sporting integrity, and that a conflict of interest was at play.

We believe the advice provided and the enquiry set up, where SFA both advised and is the appellant body, breaches not only the integrity the registration rules were intended to uphold, but also totally undermines the integrity of the SFA in breach of General Conduct rules 1, 2 and 4. (See below.)

1.  Firstly we believe that the advice supplied to LNS that an incorrectly registered player was eligible to play as long as the registration was accepted by the SFA however unwittingly, undermines the intent of the SPL/SFA rules on player registration and so undermines the integrity of football in three ways.

• It incentivises clubs to apply for a player to be registered even if they know that the conditions of registration are not satisfied, in the hope that the application will somehow ‘slip through the net’ and be granted anyway (in which case it will be valid until revoked).

• A club which discovers that it has made an error in its application is incentivized to say nothing and to ‘let sleeping dogs lie’ – because it would be in a better position by not confessing its mistake.

• And most importantly, it incentivises fraud.  By deliberately concealing relevant information, a club can ensure that a player who does not satisfy the registration conditions is treated as being eligible – and therefore allowed to play – for as long as a period as possible (potentially his entire spell with the club). Then, if the club is no longer around when the deception is finally discovered, imposing meaningful sanctions may be impossible.

2.   Secondly we believe the process followed was inappropriate due to a Conflict of Interest. Had the LNS enquiry not ruled on the basis of advice supplied by The SFA, they and those persons advising the LNS enquiry, could have been subjected to censure and the SFA to potential compensation claims had LNS found that the players were indeed ineligible to play and results then been annulled as was SFA practice when an ineligible player played.

3.  Finally we contend that a law should not be applied according to its literal meaning if to do so would lead to an absurdity or a manifest injustice or in this case loss of football integrity.

4. We therefore ask FIFA to investigate both the process used and advice given to Lord Nimmo Smith to satisfy themselves that FIFA’s intentions with regard to upholding the integrity of football under FIFA rules have not been seriously damaged by the LNS findings and also to reassure Scottish football supporters that the integrity of our game has not been sacrificed by the very authority in whose care it has been placed to promote the short term cause of commercialism to the games long term detriment.

1. Persons bound by this Code are expected to be aware of the importance of their duties and concomitant obligations and responsibilities.

2. Persons bound by this Code are obliged to respect all applicable laws and regulations as well as FIFA’s regulatory framework to the extent applicable to them.

3. N/A

4. Persons bound by this Code may not abuse their position in any way, especially to take advantage of their position for private aims or gains.

    If we want to mention howling ref decisions….who can forget Brines at St. Jonstone last year….can’t remember who the ST. Johnstone player was…but went down in his own penalty box…thought he should have had a free kick….put both hands on the ball to help himself up onto his feet…whilst Samaras was about 2 yards away looked at the ref and said..’penalty’….Brines…”play on”…WTF!

    How Brines remains in post as a ref in our top league is beyond explanation…its not the first time he has shown himself to be at best hopeless..

To this day the only player I am aware of that has stood up against his own team-mates in a racial assault case, when the Leeds student Sarfraz Najeib was beaten unconscious by Bowyer and Woodgate. Standing up to racism cost Michael friends and his place in the Leeds team. When he left St Johnstone he assured fans he would never play for another SPL team as he believed that would betray the trust and support that Saints fans had shown in him. He is now at Oxford. Great guy.

    No one suggested Duberry was cheating, that’s just a distraction.

    Regardless of Duberry’s intention, he placed both hands on the ball in his own penalty area which should have resulted in a penalty kick.

    It wasn’t given.

    Reminds me of an incident at Celtic Park where Barry Ferguson put both hands up in front of his face in his own penalty area and the ball struck both palms.

    No penalty said referee Hugh Dallas and circled his face with one hand, presumably indicating Bazza was only protecting his face!

    I’m sure its all down to honest mistakes.

  8. I never thought more of the Sandaza prank call other than to comment that the fact he signed for the money wasn’t exactly a revelation. Hearing tonight that he has been suspended I’m now of the opinion that what was a joke has possibly cost him his living or even a fine therefore I would ask was it really that clever from our friend Tommy. It’s certainly not what our Tommy thought may be the outcome but if I was Tommy I’d be feeeling guilty. Let’s hope he doesn’t lose his contract at the Rangers

    Stuart says: To be fair to my reply, the original poster (PaulMac) had no idea who hand handled the ball so to name him was hardly a “distraction” – it was a community service. Assuming that discussions of St Johnstone are not banned on TSFM I then went on to discuss one of our former players. I was led to believe since its formation that the core purpose of the blog is ‘football and fairness’, so I went on to make a short observation about a footballer’s integrity in a racial violence court case, which made him a pariah among Leeds fans. In the grand scheme of things his brave stance is infinitely more important than Ian Brines’s comedy refereeing.

    Yes it was a penalty and a blunder. But highlighting Michael Duberry’s integrity is germane to the purpose of this blog and therefore it is not a distraction.

  13. beebop65 therein lies the difference, Kevin O’Donnell was eventually hounded out the game ( chiefly by Wallace Mercer if I remember correctly ) for what was perceived as being “pro celtic” in one particular game. Other referee’s let me think , Syme, Hope , Dallas and McCluskey to name a few were rewarded for being fair and honest examples of refereeing in Scotland by being given UEFA and FIFA rankings and games, because they never ever made mistakes genuine or otherwise

    I didn’t get a chance to see the game (and resist Sky in any event), (and I should perhaps mention that I’m a huge fan of Strachan, both as a player and as a Celtic manager), but I hope tonight isn’t setting a pattern. I realise that our footballing gene pool is limited, but do we really still need to go with the same old faces? Why can’t Scotland managers build for the future instead of sticking with the same old tired faces? Kenny Miller works hard but come on, it’s time for new blood. And that is only one example.

I’m sure you see that Graham Spiers’ remarks will be interpreted by many to be a rather poor attempt at deflection from the potentailly ‘nuclear’ nature of Calderwood’s comments. Do you agree that serves to discredit Spiers himself and anyone who goes down the same route ?

    What else would be his motivation for saying something which is so transparently silly ? Sounds a little arrogant at first but then it sounds rather more defensive than arrogant. There’s quite a gap between the two attitiudes.

    ‘At least worthy of debate’ you say but I’ve seen little or nothing in this week’s press along these lines. I think it leaves a lot of questions to be answered for many observers.

    I’m sure there has been other debatable decisions over the years Stuart…the thrust of my point was how hopeless Brines is as a ref…it was an incident that sprung to mind…in Doobs defence I thought it was a foul by Samaras and should have been given…

    Im also sure Doobs is a stand up guy not knowing his past honourable conduct…and a decent player to boot.

    Ignoring the obvious connations,who thinks this is a desperate throw of the dice by Green?.
    This will be a sectarian love in and could easily sell out at say £15 a head.
    I’m sure it’ll be billed as a fundraiser for Linfield who have their own fiscal problems but this match could easily put a large 6 figure sum in the Ibrox coffers.
    Why not during the close season as usual?
    Why not in Belfast as usual?.
    This match has been rushed in and in my opinion that’s for one reason only,ready cash for Green!

    Exciting young talent has been on show and already the transition process is delivering positive results with several “Under 20” players making appearances in the 1st team.
    The strength of our “Under 20” squad has also taken the Club to Sunday’s semi-final of the Scottish Youth Cup against Celtic, having beaten Rangers 5-1 in an earlier round.

    I don’t think that’s fair. Wotte advocates the promotion of youngsters. It’s not necessarily his fault if successive managers seem to put aside their imagination as soon as the get their feet under a Hampden desk.

    The boy has done nothing wrong and given no reason for suspension.

    The fallout fromTommy’s prank call gives a real insight into how the new club treat their employees. (And I tend to agree with some other posters that there might be a different agenda to the suspension like cost savings or more likely cheap rabble-rousing at Sr Sandaza’s expense.)

    We should also wonder why our MSM haven’t picked up on the rights of the employee in this sad tale.

We have now replaced them as minnows, while the Nordic teams achieve beyond their means. Now we are in financial dire straits perhaps there’s a chance that we’ll invest more faith in our young people again? Bring on league reform, pyramids, promotion and relegation, multiples of eight, apocalyptic Armageddon penguins (climbing up the Eiffel Tower?), anything to shake off the cobwebs of insolvency fitba!

    On the face of it this is a great opportunity for 2 Teams from different Islands to get together and put on a spectacle for the long suffering fans of both clubs. But it won’t be, due to the lack of class in either team and no big names to draw the fans in. Just a sharing of a sectarian history by both clubs which will no doubt have the same effect in generating interest. But I do not see an inclination for the neutral supporter of Scottish Football to pop along and take in the match the way that a pre season friendly normally would. Both teams are showing that there is a real and urgent need for cash NOW. This, especially in the case of TRFC, is a sticking plaster on a gaping wound. It will give a very short term financial fix with the fans of TRFC once again being asked to dig ever deeper into the coffers to save the Team. These fans are left with no option. They are being held over a barrel. So how often during the coming season will TRFC have to arrange friendlies and return to the fans with cap in hand. Monthly? Season Book money will not cover the expenses that will be piled up by TRFC. Shirt sponsorship and income from replica shirts from Mike Ashley will be insignificant when taking into account the bigger picture. This may be the shape of things to come for TRFC having to stumble from one ‘Glamorous Friendly’ to another in a desperate attempt to stay afloat. The talk of war chests and stadium renovations are just that. Talk. Complete nonstarters. Is this the start of the new ‘Harlem Globetrotters’ type model for Scottish Football. Is this how Charles Green and Ally McCoist see themselves saving Scottish Football for all of us? For all those MSM pundits and ex-players who continually spout about returning TRFC to the top table as soon as possible for the good of the game I say this:
    Take a look at this arranged friendly and ask yourself this. If TRFC are going to be the saviors of Scottish Football why are they having to grub around arranging friendlies during the season? Make no bones about it.This sash bash will sell out this time. But how many more times? TRFC or more accurately their predecessors are the reason Scottish Football is unstable at the moment, but I am not sure that it needs Saving to the extent we are constantly told by TRFC mouthpieces. Look around and see the positives in the game at the moment and spare us from the constant Govan Saviours pash. We don’t buy it.

Now having read once more, I can see that you meant only in relation to taping people’s conversations. In that case, I would agree with you, he has not come in for any abuse.

    I believe there is a huge difference though. Sandaza did nothing wrong and I don’t believe he deserves this intrusion simply for being a Rangers player. The others being exposed were involved in matters that could be construed as being in the public interest and in some cases; they were playing with fire and got burnt. Craig White did not receive the same abuse as he and the others were willing participants in this charade, you reap what you sow sort of thing. Sandaza is not a farmer, just a simple guy playing football.

    I stand by my initial reaction, in my opinion it was not funny and targeted the wrong person.

    I don’t think I could say he did nothing wrong without seeing his contract as I would think there may well be a clause preventing him publicly discussing the details of his contract, especially remuneration, as that could obviously have an effect on the wages bill for the club.

    I haven’t listened to Tommy’s tape and actually have no interest in doing so although I did listen to some of his other ‘coups’ such as Imram Ahmad. So I am not sure whether there is anything else he said that might contravene his contract of employment.

    Some might argue that OK technically he might be wrong legally in terms of his employment contract but I do believe he has got it wrong morally as well because his loose mouth – and possibly brain – could cause dressing room aggro over wages to the detriment of the club and supporters.

    I agree that he shouldn’t be singled out simply because he is a Rangers player or indeed a player of any other team. Tommy presumable was on a fishing expedition unless, of course, a spource had told him that Sandaza had been moaning about being at Rangers and playing in SFL3 and that would make him fair game for a call IMO.

    One thing that surprises me is that there appears to have been no reference by Tommy over the reported problems over his religious adhererence as that seems to me to be the only thing that would actually make the phone call legitimate in terms of being newsworthy.

  60. Overpriced, overrated, inexperienced and going backwards. With no prospect of fresh overpriced, overrated, inexperienced (at that level) players for half of the next campaign, IMO unless there is another helping hand from officialdom, successive promotions might be a little harder than they think.

    Until they can throw money at it, which they might not have soon, I predict some seriously honest mistakes or one almighty one which puts them back in the SPL.

    But don’t get me wrong, I know they have good youth. I know if they stick with the same staff and look at building for the future, with youth. As Charlie says, they would return stronger or more like, better for it. Only thing is, everyone has a 10yr head start on them and a better track record of producing, and the bears won’t keep watching the mince that was on show today. Thats why the future is most definitely orange and corrupt.

    The guys that run Brewdog are genuine and dedicated, and they’ve recently moved to a custom-built brewery in Ellon from the Broch.

    They’re always working on new recipes, and have done a bloody good job of hauling their business up through bloody hard work, a love of what they do, and not subscribing to the easy route of pandering to the masses with watery, fizzy pishy “beer”.

    Meanwhile, hats off to Stirling for taking 5 points off TRFC in 4 games this season. Who’d have thought? Must amuse myself with a visit to RM later.
